Scylla dear Sir

I am here in USA as B1/B2 visa with my family we have life threadh in pakistan i do have proof just want to know i am going to cross illigel to canada even do we have applied last year TRV which they have refusel with no reason. My brother is in Canada as workpermit he dont no even i am coming will they allow me to pass and arrest me. please help i am on last stage cannot go back.

you will be arrested after crossing and if you have no criminal history you will be be able to apply for asylum . but it not a easy process. try to apply on legal border crossing. as your brother is living in canada.

Since your brother has a temporary status here in Canada you are exempt from the Safe Third country Agreement and you can cross through an authorized Point of Entry.

Canada-U.S. Safe Third Country Agreement
Exceptions to the Agreement consider the importance of family unity, the best interests of children and the public interest.

There are four types of exceptions:

  • Family member exceptions
  • Unaccompanied minors exception
  • Document holder exceptions
  • Public interest exceptions
Family member exceptions:
Refugee claimants may qualify under this category of exceptions if they have a family member who:

  • is a Canadian citizen
  • is a permanent resident of Canada
  • is a protected person under Canadian immigration legislation
  • has made a claim for refugee status in Canada that has been accepted by the Immigration and Refugee Board of Canada (IRB)
  • has had his or her removal order stayed on humanitarian and compassionate grounds
  • holds a valid Canadian work permit
  • holds a valid Canadian study permit, or
  • is over 18 years old and has a claim for refugee protection that has been referred to the IRB for determination. (This claim must not have been withdrawn by the family member, declared abandoned or rejected by the IRB or found ineligible for referral to the IRB.)
Family member
The Safe Third Country Agreement recognizes a family member as the following:

  • spouse
  • legal guardian
  • child
  • father or mother
  • sister or brother
  • grandfather or grandmother
  • grandchild
  • uncle or aunt
  • nephew or niece
  • common-law partner
  • same-sex spouse

If the person dont have canadian visa he still can cross border legally. Will they let him enter to canada if person claim asylum at US-Canada border without TRV. If any family member lives in canada

No, you don't need a TRV. If you successfully proof your relationship with your brother then the officer will not return you to the USA.

You should bring proof of your relationship with your brother and his status in Canada (Copy of his Passport/WorkPermit/TRV). The officer will probably try to contact your brother to confirm the information you are saying, so also bring his contact information.

Proof of family relationship


When a claimant identifies a family member in Canada, the officer must be satisfied that the relationship is one that qualifies the claimant for an exception. The standard of proof is “balance of probabilities”. The claimant is responsible to provide information to establish the relationship and status of the family member. However, in some cases written documentation, such as birth, marriage certificates etc. may not be available. In such cases, credible testimony may be sufficient provided the officer is satisfied with respect to the claimed relationship. If the testimony is not sufficient, attempt to confirm family relationships and that the relative has the necessary status in Canada. This may be done by:

  • contacting the claimed relative;
  • review of documents provided by the claimant
  • FOSS checks
  • review of files held by other CBSA offices
  • review of IRB records
  • checking city directories, telephone books, internet sites, etc.
  • statutory declarations (may be useful but are not required).
Any contradictions or inconsistencies that result in doubt about the claimed relationship should be documented in detail.

Persons identified as a family member in Canada
There is no support expected from the anchor relative. It is sufficient for the claimant to establish that a relative exists and that the relative has the required status in Canada. The anchor relative has no say in whether or not the claimant is allowed to enter Canada.

If the anchor relative has a FOSS ID:

  • put a general information (“12”) NCB in FOSS to indicate that this person was identified as an anchor relative.
  • read NCBs to determine if the anchor relative has been identified by other claimants. Multiple use of the same anchor relative could merit investigation.

agent told me if i legaly crossing border even my brother is there they will return me to usa,

i have a question i have passport copy of my brother and his contact infomation

what if my brother will say to them he dont no me even on his and my passport father name is same and i have his picture with me too, what can happen i am just worried since my brother is very scared. do i mention his name or no just cross

I don’t know what your agent was referring to, however according to the information on the CIC webpage you meet one of the exemptions of the Safe Third Country Agreement and should be able to claim refugee at an authorized port of entry without being returned to the USA.

You have to mention all of your brother’s information to the immigration officer. It seems you have enough proof of your relationship with your brother, if I were you I would try to get a copy of his canadian work permit or TRV as well and his contact info.

Your brother will not be affected by your refugee claim, so he shouldn’t be afraid.

No, you can only cross if you have a valid visa or if you claim refugee at the authorized port of entry AND fall under one of the exemptions of the Safe Third Country Agreement.

You are missing the point. You HAVE to tell them your brother is in Canada, one way or the other. The fact your brother is currently in Canada legally, makes you eligible to claim in Canada. If you don’t tell them about your brother, it could result in you being held for misrepresnetation and there is an increased chance of being sent back to the US under the Safe Third Country agreement. Better to to use your brother and enter legally.

Your brother doesn’t have to do anything he doesn’t want to. Your refugee claim is independent of his situation in Canada.
An officer will probably only call your bother to confirm information about your relationship.

Shelters are for people with limited resources or no money. If you have money you can look for your own place.

Right now there is a backlog of about 40,000 refugee claims. So you should expect your hearing to occurs in 12-16 months.

You will have to tell the officers about your brother, no matter how you choose to cross.

If you decide to cross ilegally you and your family can be arrested/detained by the RCMP.

As well, crossing illegally can have long term consequences for you. For example you can be listed as a “Designated Foreign National” which will prevent you from applying to become a Permanent Resident for 5 years after you receive your Refugee decision.

There is no need to cross the border ilegally, you have the opportunity to claim refugee at an authorized Port of Entry. Please do the responsible thing and don’t expose your family to the risks of crossing ilegally.

Am I the only one that sees the irony? Seems like they had very good reason to deny your TRV, considering that:

1: You clearly misrepresented the intent of your visit to Canada. TRV is for people who want to go on a holiday, not to claim asylum.

2: By expressing a desire to cross illegally you are demonstrating your blatant lack of respect for Canadian immigration legislation. They may not chuck people into off-shore camps or keep you in prison until your hearing, but crossing illegally is still very much a crime.

However, as many others have said, as you have family in Canada you are exempt from the Third-Safe country agreement. Please be a law-abiding individual, show respect for the rules of the country you want to offer you refuge, and cross at a designated point of entry.
