Hi everyone who can help,

I have 30 days left to respond to immigration with legal documents and have no clue what i need to providw. I tried contacting manila regarding this situation but their response was so vague i didnt know what to do.

Here is the current situation:

My wife who is south korean has applied for pr in canada. We both currently live in seoul south korea working. I have lived here for 11 years now but we recently got married. We decided to apply for pr outside of the country as we can save money here while waiting for processing. We know it will be tough to get a good job in canada.

I was eligible for sponsorship when we applied to canada with our hefty package. They then transferred all the processing to manila. Recently we got an email from them saying that i have not provided sufficient legal documentation for myself to prove that i will accompany my wife to canada when she is eligible for pr. So they basically believe i will stay in korea and work while my wife tries to stay in canada. I understand why they would ask as i have worked here for 11 yrs and don't have a job. Our simple plan was to move back to canada together when we found out the date she is allowed to come. Isn't this possible?

Also and more importantly, what legal documentation are they looking for? Flight booked? Promissory note from myself or my family saying that we will be living with them? I have no idea what they are looking for. Any help would be much much appreciated. Thank you for your time to read my situation.

Canadian citizens can sponsor their spouse while abroad, with the condition of convincing the VO that their intention is to move to Canada once the spouse is approved as PR.

They accept as evidence: job offer from Canada, rental agreement, mortgage on property, etc. But lots of people like yourself, who have lived abroad for many years, are having difficulty in providing the documents CIC want. My husband and I are in the same situation. He is a Canadian citizen who's lived abroad for 7 years.
Now, one would say the best way to avoid all this is for the Canadian spouse to move to Canada while waiting for the application to be approved, but this is easier said than done. No one wants to leave a spouse behind.

It is also very hard to get a job offer from Canada while you live abroad. I know, my husband tried.

We haven't been approved yet, but to give you some ideas, I can tell you what we have as proof of relocating back to Canada:

1. Letter from family members in Canada stating that they know about our plans of moving there and that they will offer us housing and financial support until we get back on our feet (find jobs, etc.)

2. Letter from my husband's current employer stating he has been informed by my husband of his intention of moving back to Canada and therefore he will be quitting his job once the application is approved. (you wouldn't inform your current boss of all this if you weren't serious about moving, right?)

3. A copy of an email conversation between Service Alberta and my husband, containing an inquiry for the driver's license. My husband asked information about the process of converting a German drivers license into a Canadian one. He mentioned in the email that he lives in Germany but is planning to move back to Canada.

4. A copy of an email between my husband and a job agency in Canada. He stated in his email that he is planning to move to Canada once I get approved for PR and has started looking for possible job opportunities in the area (he sent CV, portfolio, etc.). The agent he spoke to replied that he is very interested in his profile and once he arrives in Canada, he will be able to find enough employers interested in hiring him. (this is almost like a job offer)

5. Last but not least, a letter which my husband wrote, explaining in detail his plans of moving back to Canada, including reasons why. It was a two page letter, covering almost all aspects of this move, his inability to find a job offer in Canada from abroad, reasons why he would not leave me behind, etc. (he even said he will not go back to Canada without me).

I hope this helps and I wish you good luck. Maybe other members in a similar situation can give you more tips/ideas.

I agree with Avadava. Those are all good ideas for formulating your response.

A few others;

1. Tell them you have visited websites x,y and z looking at properties to buy or rent in Canada when you return. List the URLs of those websites

2. Tell them you have visited websites a,b and c looking for used vehicles to buy when you return. Again, list those websites and URLs.

3. Tell them you have spoken to moving companies in order to estimate the cost of moving once your PR is granted. List the names of the companies. If you haven't done this, get your wife on the phone tomorrow to make a few phone calls.

4. Moreover, tell them it is impossible to finalize your plans because you do not know when CIC will be granting PR.


Good luck. I wouldn't be overly concerned. This seems to be a pretty common thing for the Manila VO to request these days. There have been several people over in the Korea specific thread who have had the same request.

Go to a lawyer and ask him to legalize a letter in which you state
that when your wife gets her permanent residence you will be moving back to Canada,
as it is your intention to relocate to Canada and have a family over there,
that you will seek suitable accommodation, will return to Canada and will not have
work preference and will be working in available jobs until you can find a job according to your background....

That is a legal document,
it states your intentions but have the legal power of a lawyer...

and that is what they want.....

Further more,
you can present a letter from your employer stating that he is aware of your intentions to return to Canada
once your wife residence is available and will provide the necessary one month ? notice to find suitable replacement to your duties....

Also, you can present your job search in Canada,
for example you can go to the National Job bank and
send some resumes....

Sorry, I don't mean to be contrary but that is not what they are asking for. A simple letter outlining his intentions and details of what he plans to do, will be enough. If CIC wanted a sworn affidavit to that effect, they would have asked.

The additional problem that the OP will have is that he is in Korea. Having had to swear affidavits myself in that country on a couple of occasions, I can tell you that the lawyer will insist on a Korean translation of the affidavit before he will commission it. By the time you pay for the translation and the notarization, the OP will be out around $200.

Manila has requested the same information from several people over in the Korea thread over the past 6 months. They just responded with a letter outlining the information Avadava and I (and you) suggested and they've been fine. I wouldn't waste any money on getting a Korean lawyer and translator. It's simply not necessary.

It really doesn't matter if it is legalized by a lawyer...
what matters is the statement of intention....

I was suggesting legalizing due to the fact that Manila requires legal documents....

But a signed letter of intention is a legal document also...

In Canada, a will can be done by each person and sign...
and will have all the legal power as if a lawyer has done it....

then a letter will have the same legal power....

When my ex wife allowed my children to come to Canada without her,
it only took a signature of her allowing them,.... it was not a lawyer present...
but her signature carried all the weight as if a lawyer was present...

Its similer to my case My wife is Canadian Citizen living in South korea with me and i am not korean.
She is here more then 5 years and after sending our approvel they ask additional docs because manila embassy were not stisfy with my wife intention to move to Canada then we sent additional docs like bellow.
1- letter from here employer stating that she will move back after getting her Husband PR VISA.
2-We sent letter of Ontario transpotation, my wife driving license is going to expair so we send letter to ontario transpotation and they send us letter and state that she can come and renew her driving license.
3-e mails from friends and family.
4- notery attaested letter from family stating that we can live with them till we settle in Canada and they will provide us living space and food stuff without any cost.
5- my wife and my bank statment showing our saving money in korea.
6-shipment we sent our home stuff which we are not using some cloths etc and my wife make letter and mantion all detail why she is stay here and what her plan in Canada.
7-Job search detail,jobs alart e mail notification that she is searching jobs because she is out side Canada thats why she can not get job easilly.
8-Her Canada bank account statment and show them saving.
9-latest income tax return.
10-Self letter and discribe all her plan and detail about why she want to move to Canada for good.
