Hi Everyone..i'm in need of advice and hopefully be pointed in the right direction...So I'm a Canadian citizen living in the States for the last 8 years,i am in a common-law relationship with a Mexican national we have lived together for 8years..but have been in a relationship for 12 years ..we have two children in common who are U.S citizens ,i have 2 Canadian born children living with us in the states....we would love to go back home to canada and start a life there as a family, but the only thing stopping us ,is my partner not haveing any legal status here i the states ..he has lived in the states all his life was brought across the border when he was a child...he has supported us all this time..how can we start the process of getting him Pr status in Canada? Would we have to seperate(don't want to do that, all 4 kids are really attached to him) would he have to go to Mexico before anything can be done(again not wanting to do this as he has no ties there.all his family is in the states) i'm scared and worried as to how to go abouts with this whole process..we want to stay together as a family... Please help us..what can we do?

Hi

You need to apply to sponsor him. His illegal status will not be a cause for refusal. He does not need to return to Mexico unless called for an interview, which is extremely unlikely given the 8 years living together and 2 kids. You guys need to be 100% honest in the app about his illegal status.

Assuming you were born in Canada, your children are Canadian. You need to apply for their Certificates of Citizenship ASAP, as it takes many months to process.

There is no minimum income to sponsor a spouse. You guys need to show that you can support yourselves in Canada without welfare. IRCC will look at your family finances as a whole. You can show income, income potential, savings, investments, family assistance etc. If your family is going to help you or provide you with a place to stay, have them write a letter.

You will also need to provide proof that you intend to return to Canada.
