Hi everyone,

First of all, thank you for visiting my topic and moreover if you can help with my problem. I am really glad to find this forum, people are nice and willing to help. I really appreciate it.

So here are my conditions:
-I am a visitor in Canada, from a not a visa exempt country, I entered Canada with a single entry TRV in February.
-I want to apply for a Study Permit inside Canada if it's possible sot that I don't have to go back and apply in my country

Here is my references:

From the new regulations (cic.gc.ca/english/study/study-changes.asp):
As of June 1, 2014, certain foreign nationals may apply for and receive a study permit from within Canada. These include:

minor children studying at the primary or secondary level;
exchange or visiting students; and
students who have completed a short-term course or program of study that is a condition for acceptance at a designated institution.

From this link (cic.gc.ca/english/information/applications/guides/5552ETOC.asp), I found the points that you visitor may apply inside Canada, here is some that I highlighted:

1.Holders of temporary resident permits (TRPs) valid for a minimum of six months and their family members;
2.Visiting or exchange students studying at a Designated Learning Institution (DLI);
3.Persons who have completed a short-term course or program of study that is a prerequisite to their enrolling at a DLI;

So, from that references, unfortunately non of the conditions apply to me to be eligible to apply inside Canada :(
Because I am not from the "certain foreign nationals", which I guess only people from visa exempt countries because on the Instruction Guide it said holder of TRP.

However, I am thinking If I can be the point number 3. Persons who have completed a short-term course or program of study that is a prerequisite to their enrolling at a DLI;
Let say, I will extend my visit to get a visitor record, so I can go to an ESL course in which after I finished the course I can get the letter of acceptance from the uni/college. So I can apply for a study permit inside Canada.
Do you think this is possible?

P.S.
I have been preparing for the study permit application, but I didn't now that it must be conditional letter. I actually already got a Letter of Acceptance from a DLI, but it won't work because I use my CAEL/IELTS/TOEFL exam to be accepted without needing any ESL course.

You are correct, as I read the regulations.

I would think yes on the ESL course. However, CIC might interpret the regulations to mean that the University has to ask you to take the ESL course in order for you to qualify for in Canada processing of the SP

Thank you txboyscout for your kind response.

I have come to some institution here (uni and college), basically they are more than welcome if we want to take ESL first before going into the academic program.

But, just something that make me not sure about this, a friend of mine, she works as an educations agents. She said that CIC will know that my first intention was only to visit, even I don't need a study permit to take ESL, usually she helped students apply for a visitor visa and tell the VO that they are going to enroll in a ESL course.

I am not sure about that. What do you think?

Your plan will only work if the short course you take is an actual / real pre-requisite for the course you then take at the DLI. Taking an ESL course when you already have a non-conditional letter of acceptance from a DLI means the ELS course is NOT a pre-requisite. CIC agents aren't idiots - I think it will be pretty clear to them you don't need IELTS as a pre-requisite for entry into your program.

So based on the information you have provided - you don't qualify to apply from inside of Canada.

My plan is to go the another DLI, not with the one that I already get a non-conditional LoA. And if I can take the ESL course as a pre-requisite course to be accpeted into the academic program without providing any English proficiency test result (like CAEL, IELTS or TOEFL)

What do you think about that?

I think this will only work if you have an acceptance letter from a DLI that clearly states that you must take an ESL course to be admitted into their program. The fact the ESL course is a pre-requisite needs to be in the actual DLI acceptance letter you receive. In other words, I think you need a conditional letter of acceptance from a DLI that says you need to take an ELS course to be accepted into their program.
