Need Advice on PR Application Reconsideration and Planned Actions

Timeline and Key Points:
  • Applied for PR on July 20, 2023, through EY, my agents.
  • On October 24, 2023, EY received an email from IRCC asking to link my application through GC Key or interact.
  • On the same day, they received query from IRCC regarding documentation updates required for my PR application.
  • Neither of these emails was forwarded to me by agency or IRCC. No follow up either.
  • Due to EY inaction and non-communication further by IRCC, my application was returned on November 10, 2023.
  • I discovered this only when I called IRCC on February 7, 2024, to inquire about the status of my application.
  • Despite continuing attempting to contact EY , I received no response.
  • An IRCC representative advised me to submit a new application, as the fees were still in the system.
  • However, my new application submitted on 18th April 2024 included an expired Letter of Support from the Startup Visa program, rendering it incomplete as per clause R10.
  • The startup agency is not authorized to reissue a new letter of support for the same company according to the new IRCC guidelines released on 30th April 2024.
  • Given these circumstances, I intend to withdraw my new application and request IRCC to reconsider my original PR application.
  • The failure and non- communication from EY to me was not my fault and led to the return of my application.
Planned Actions:
  • Request Reconsideration of the Original Application - Submit a detailed request for reconsideration to IRCC. Provide a clear explanation of the communication failure by EY. Offer any supporting documentation that verifies my claim (e.g., email records, correspondence with EY).
  • Withdraw the New Application - Contact IRCC to formally withdraw the new application. Explain the issue with the expired Letter of Support.

There are no timelines for reconsideration requests and IRCC doesn’t have to re-open your file. Reconsideration is for those who saw an error in law and don’t need to resubmit new documents.
There are no timeline, but the IRCC will get back to you in 30 days if you have a chance. Unfortunately reconsideration is not a formal process with processing times. It can take weeks to months.

There's no harm in requesting reconsideration.

The factors working against you:
- You are held responsible for your application regardless of whether you applied yourself or through an agent. When you apply through an agent, all communications go to that agent.
- Your application was incomplete and you didn't respond to IRCC's request for more information.
- While there is technically no time limit for requesting reconsideration, you're six months post the application being returned and have since applied filed another application.

So again, no harm in requesting reconsideration. However I would assume the chances are low it's going to work out and have a plan b.

2. Would it be advisable to keep my current PR application active until I receive a decision on the reconsideration of my previous application?
1. Don't know.
2. I'm not familiar enough with the new / recent Start Up Visa rules regarding the caps to comment.

Any update on your reconsideration request? It's been 5 months since we receive acknowledgement that they forwarded it to responsible office the but until now no update or emails. I'm so stressed
