My 2009 application (in the FSW category) was rejected last December (31 months) due to a medical inadmissibility issue that arose during the immigration physical. While I don't need treatment (medication,) the medical officer decided that because I might need it in the future it was an issue. I provided extensive employer funded insurance coverage (100%) but she ruled that because BC offers the coverage that my own insurance was immaterial.

I've been in Canada on a work permit since September 2009. Given that I contribute more than 10x the annual limit for medical inadmissibility in taxes alone and can do my work from pretty much anywhere in the world I'd have simply moved back to the US.

But somewhere along the line I managed to meet, fall in love with, marry and set up home with someone here in Vancouver. Immigration to the US is not a viable option in our case, however, so I'm dual track at the moment - a judicial review appeal in Federal Court and now (after having someone talk sense into me) a sponsored spousal application here in Canada. I figure either path is going to be 18-24 months, but we shall see how it goes.

At any rate, good luck with your own application - I hope for your sake it is done before I even get my day in Court (assuming I get a date in court - it's not automatic, it's an "application for judicial review").
