Nanny work permit for own sister

Hi All,

I have nanny LMia,my sister is nurse back home. could i hire my sister as nanny and start her work permit process. Would it be an officer concern about giving job offer to own family member??

You can certainly try. We see a higher rate of refusals where the person being hired is a family member. So yes, this may be a concern for the visa officer.

There was lots of fraud by when people hired their relatives under the live-in caregiver program so that is why many family members are refused. Yess a nursing degree should qualify her as a nanny.

Hi,

Yes I understand how IRCC check and review applications for Caregivers with relatives as employers. I just hope IRCC will look at the qualifications and credentials too, and not just rule out everything just because the Employee-Employer are related to each other. Just saying.

Many used the caregiver program to gain PR status without actually working as a nanny so it is normal for CIC to be reluctant to sponsor relatives especially if they would not qualify for immigration otherwise. If your family can show that they have the budget to afford to pay a nanny around 30K a year and your sisters qualification and experience correspond to what is required for a caregiver she has a good chance. She always has the option of working for another family as a nanny.

I understand the IRCC point of view Yes, the family can show their NOA as proof that the employer can pay the caregiver. Their income is at $110,000 I think, they have one child only, plus the employee's qualification is acceptable. Well, it is still at the hands of the officers. I heard some got approval and some were unfortunate to get positive result because of being related to each other.

Paying around 30K for a nanny when you make 110K doesn't make sense especially for 1 child. 101K is before tax so they make substantially less.

I see. But that part has already been assessed by ESDC right? I mean the capability of the Employer to pay the employee is done during the LMIA process. They will be able to check from that stage that the Gross Income is only $110,000.00.

Total Income $110,000.00
LICO Figure ($33,000.00)
Employee Wage ($30,000.00)
Surplus of $47,000.00
as per ESDC, if the total is positive, the employer may be considered as having met the financial ability requirement.

but as I said, it still depends on the officer examining the file. Thanks for your input.

IRCC will complete a separate assessment to determine if they feel the employer has sufficient income. It's good news that ESDC has approved but this doesn't guarantee IRCC will agree.

Just raises concerns that the goal is getting immigration for the sister versus needing a nanny. You are not looking at after tax income. Over a 1/3 of their income would go for childcare for 1 child. I assume this has nothing to do with childcare and is a route to immigration. Childcare is expensive but most do try to find the most affordable option in order to potentially save money or allocate it to housing, transportation, etc. costs. You'll have to se what reply you get just warning you of these red flags.

Hi Scylla, thanks, yes I am fully aware that having a positive LMIA is not a guarantee that IRCC will approve.
