NAFTA visa -- management consultant and express entry

I am an American with an occupation that falls under NAFTA categories -- management consultant. So I am working on finding a job in that area. Two questions:

1. Does it make sense to also apply for express entry/skilled worker? Or would that just be a waste of time/resources? I had already done the IELTS language test and degree equivalency verification before finding out about the NAFTA option (which already feels like a serious waste of resources) but I'm not sure if completing the express entry profile would help or hurt me if I also manage to get a NAFTA category job offer.

2. How particular are they about the job title and structure for management consultant category? Can I get a job offer with a different title that still describes the function of management consultant? And does this job need to be structured as a consultancy rather than full time to qualify?

Hi!,

with regard to your questions below,

1. You can absolutely apply for skilled worker while you are presently applying for NAFTA. And once you have landed an offer based on NAFTA, acquire your NAFTA work permit, I would look into whether you can modify your EE/SW application to reflect credit for already working in Canada (I acquired PR last year, prior to the existence of EE (express entry) but I know you can have two applications pending in more than one stream at the same time.

Just find out whether you can modify your EE/SW application when you get here to reflect the fact that you are now here working/residing legally.

2. I have read there some complications for working in the management consultant category. The CIC is sensitive to the use of the management consultant category as a manager. You will need to clearly demonstrate a role as a consulting manager rather than a manager.

For example, read the following paper that discusses the distinction between management consultant and management, and it seems CIC is watching very carefully for this when adjudicating an application for a LMIA-exempt permit such as NAFTA the the purpose of employment as a managment consultant:

It would seem if both you and employer maintain the correct context of your intended employment in both your correspondence and the TN TWP application process, you should be fine.
