Hi everyone,
My boyfriend of 3 years qualifies for a TN visa under NAFTA (he is a graphic designer) and it looks as though he is going to receive a great offer from a firm in Vancouver. He has his diploma and passport, but I have a couple of questions and concerns about his entry.
First off, the letter:
Because the TN visa is a temporary worker visa, how should it be worded? He's very concerned about flying from Chicago to Seattle and being turned away at the border because the letter doesn't illustrate intent to return to the United States. He doesn't own any property in the US, nor does he have an American job offer for a future date. What have others done to illustrate how temporary the position is?
Second:
Can we submit two separate applications at the same time? Although he'd be entering under NAFTA, we would like to apply for permanent residence under family class sponsorship as well once we are in Canada. He and I have lived together for over two years and are considered common law spouses. I'm in the United States as a student, but I graduate in May and will be returning to Canada then, hopefully with him. Because, under NAFTA, you have to demonstrate an intent to return to your home country because your job is temporary, isn't that a conflict of interest with a permanent residency application? We have no intention of lying at the border so we want to know what to say and how to say it so that we are able to do both of these things?
