So we got DM and ppr, in the entire application my son was included as a dependant we also did do a separate proof of citizenship application for my son and we did mention on the cover letter for the sponsorship app that we included my son in the event that the sponsorship application was approved sooner than the citizenship app. They did ask for proof of the application for citizenship for my son and i had just received the AOR for that ... but now they stamped my wifes passport and returned my sons passport with nothing??? The citizenship app is still at "application received" so is not in process yet ...

Unfortunately you can't just go with the process that finishes faster. Because your son is a citizen by birth, he doesn't qualify for a PR visa. So it was expected that he wouldn't get the PR visa passport stamp. He's already a citizen and doesn't qualify for PR for that reason.

thx for the reply, thought so too, but this was actually suggested by the lawyer, and throughout the entire process IRCC never said anything even asked for my son to do the med exam and all, even charge the fees ... if they werent going to stamp it why charge the fees and make us go through the entire process with him

Your lawyer was WRONG. You shouldn't have put your son as a dependent (but yes in the additional family form), since he's applying for Canadian citizen.
So they under-go all check for a non-Canadian dependent for all the steps as you have provided. Did you write an additional letter to explain that your son is applying for proof of citizenship?

They cannot stamp the visa because a Canadian cannot get a PR visa.

There are other ways to get travel document while waiting for proof of citizenship. I do not have the details here. But your lawyer seems... not knowing the steps. Is he/she a Canadian immigration lawyer?

I have personally never seen IRCC issue a PR visa where the applicant was a citizen by descent.

yeap he is registered in quebec and ontario ... so basically he made me pay all the fees for my son for nothing ??... what I find odd is that IRCC never said anything!!! even though we mention it in the cover letter of the sponsorship app, even added the receipt number for the proof of citizenship application and all since at the time I hadnt receipt the AOR for the application number and they never once mentioned anything and always listed him as dependant in all communications etc ..

https://www.canada.ca/en/immigration-refugees-citizenship/services/application/application-forms-guides/guide-5525-basic-guide-sponsor-your-spouse-partner-child.html

Dependent child
If you’re sponsoring a spouse or partner, any dependent children should be listed on their application forms. If you are sponsoring one or more dependent child(ren) as the principal applicant(s), you must submit a complete set of application forms and documents for each child.

Note: Canadian citizens can’t be sponsored. If you have a child who was born after you became a Canadian citizen, or your child was born in Canada, they might be a Canadian citizen. For more information on dependants who may be Canadian citizens, see Step 5 below.
_____
Details in Step 5
Children born to Canadian citizens
  • If you’re a Canadian citizen who is sponsoring a spouse or partner, and you have a child together, your child may be a Canadian citizen, even if they were not born in Canada.
  • A Canadian citizen is not eligible to be sponsored.
  • If you already have proof of Canadian citizenship for your child, provide a copy of this proof (citizenship certificate or copy of Canadian passport), to help us confirm that your child does not require immigrant processing.
  • If your child was born in Canada, you can provide a copy of their Canadian long form birth certificate(s) instead.
  • If you don’t have proof of Canadian citizenship for your child who was born outside Canada, you need to apply for a proof of citizenship to confirm whether your child is a Canadian citizen.
  • If it is confirmed that your child is a Canadian citizen, you’ll be able to apply for your child’s Canadian passport.
  • If your child is not a Canadian citizen, you’ll need to add them as a dependant on the sponsorship undertaking signed for your spouse or partner.
Important: If you’ve submitted an application for proof of citizenship for your child, and it hasn’t been finalized, you must provide details in a letter and include it as part of your application so that we can check the status.

If he is a lawyer at the bar in one of these provinces, ask him to request the money back from government or refund himself. If he doesn't wish to, complain to the bar. This is a basic thing and a clear and evident error on the lawyer's part.
