My Wife's Open Work Permit status change

Hi,

My VISA/WP expires on Feb 1, 2016 and my extension is submitted on Dec4, 15.

My Wife also got Open WP and expires on the same day.

I got to know that once the extension request is submitted, then my status will go to "Implied Status" and able to work.

Want to check if my wife's WP status also goes to "Implied Status" as she is trying for the job now.

Or do we need to wait till I receive my latest WP letter and then apply for her WP.

Let me know if you need any more details.

Waiting for some help ASAP.

It's a general rule, not just for BOWP:
If you apply for visa/work permit extension before the old one expires and visa/wp expires before a decision is made you are put on implied status.
Implied status has the same restrictions as whatever you are extending (so if you're extending a closed work permit then you're still locked with the same employer)
Implied status starts when your current work permit expires (not when you file application) and ends when decision is made.

So yes, if you've applied to extend your wife's work permit she will be put on implied status if the decision has not been made by the time her current work permit expires.

Hi Rajesh,

Did you apply for your wife as well? If not you want to do it right now. However, I am not sure if it is considered because the recent rules states that to get your spouse work permit, the principal applicant's work permit should be minimum 6 months left when applying. So in this case I am not sure, if they consider her applications because it will not meet the requirement.

I suggest you to consult a lawyer for this and just not rely on this forum only.

Actually, my company has a third party vendor who process the applications. As per them, they submitted my WP extension & my wife's visitor VISA application.

Now the question is, Vendor submitted my request on Dec 4, and how I should submit my wife's Open WP request?

As per the CIC informaiton, WP extension may take between 110 - 140 days, Do I need to apply her WP extesion after receiving my new WP.

Please suggest.

Hi,

This is kind of weird, since most of the vendors apply for extension of Work Permit before Visitor Visa (TRV).
I believe your wife's work permit extension should have been applied along with you.

Still you may be able to apply for the extension of your wife's work permit.
Generally the extension of status for dependents goes along with the primary applicant's application. Once the Work Permit's are approved the TRV applications are filed.
