my chinese wife might be pregnant now. does that change anything about the process we have to do? I feel like that is some good proof of genuine relationship but im just wondering do I need to do anything extra now? I havnt submitted the application yet but we will be soon. also can my baby be born in a canadian hospital? Do I have any rights like that?

Theoretically a child does not equate to a genuine relationship (many people have children together and are not in relationships with one another).. but as long as it is not the only proof you have submitted, it can strengthen your case... Mentioning a pregnancy on an application can't really hurt (hopefully medicals are done already, certain aspects (X-rays) cannot be done on pregnant women and can cause delays until after the birth..

If you do not get thru before the baby is born, CIC will want the baby's info (birth papers on file, and you will need the Childs citizenship and/or travel papers - best to get that moving as quickly as possible when he/she is born)... If you are a PR yourself, you will need to add the child to your wife's application

If you are a canadian citizen by birth or immigration, your child will have a right to citizenship if born outside of Canada ... If you are a citizen through birthright (born outside of Canada to Canadian parent(s)), your child born outside of Canada would not be a citizen at birth and need be added to the application...

Until your wife has rights to Canada, the child has no rights until after he/she is born... Sorry...

As I have read in one of your other posts, you are a born Canadian and so your baby will inherit your citizenship regardless of where it is born.

You do not have an automatic right for your baby to be born in a Canadian hospital. You can try to apply for a visit visa for your wife to go to Canada with you before the sponsorship is through but visas for spouses are often denied based on risk of overstay. If it were allowed, she could stay up to 6 months, then apply to extend etc. and your baby could be born in Canada but mind you, if your wife is in Canada on a visit visa, she will in most cases not get health care which means that you would have to pay for the entire cost of her pregnancy care and childbirth out of pocket. That could be thousands of $, especially if there are complications.

Otherwise, if the baby is born where you are, contact the nearest Canadian embassy to apply for the babies citizenship certificate as well as temporary passport. That way, the baby will be ready to travel by the time your wife gets her PR. You should also update the additional family information of your wife when the baby is born because it should be on that form.

Has she already had her medical done? If not, she'll have to wait until after the child is born for the medical, though some doctors will do them very late in the pregnancy. But definitely not in the first stages of pregnancy.

If she hasn't had the medical yet, being pregnant can delay that which delays the date you can apply and delays the date for her to get PR so yes, unless you want to leave baby and wife and go home alone, you are stuck in China for a while.
