Hi Everyone,
I submitted my visitor extension application online last night. I just wanted to share this because I have been reading all the posts and it has helped me so much in this process. Thank you everyone for all of your advice and important information. I hope in the future I can be of help to someone as well. ;D

My Canadian boyfriend and I met online 5 years ago. I am from California! 8) We have traveled many times back and forth to visit each other within the past 5 years. I have been here almost 6 months on this visit and I requested an extension to "establish common law", we will then apply for my PR.

I am sure I will have questions for you all once I start the PR process. I am so glad I found all of you, it makes it seem like I am not all alone. :)
I will write and let you know if I was approved.
Hugs & Smiles!!
Tracy

Re: My Visitor Extension application submitted......need some help!

My Visitor Extension was granted!!

I have some questions, hoping someone can answer for me.

Here is my situation:
I have been in Canada since April 2014. I am from California. My extension was granted and expires June 1, 2015. We will have "common law" by April 2015. I will be leaving to go back to the states for my son's HS graduation at the end of May 2015. My plan is to apply for PR before I leave and then when I come back I can let the border agent know that I would like to stay in Canada while my PR application is being processed. I know that it is up to each agent to approve a timeline of when I need to leave Canada again. Would it help to have a return ticket back to the states or since I want to stay in Canada during the PR process is it okay not to have one? I just don't want to confuse them by having one if my intent is to stay while my PR application is processing. It's so confusing!!!

Now for another question. Can I apply for a temp work permit and work here in Canada as a temp resident? My letter states that the type of Permit is: VR and there is a Document #.

When I looked online in regards to applying for a work permit it stated
•Holders of temporary resident permits (TRPs) valid for a minimum of 6 months.
So is my permit different and would I still be able to obtain a temp work permit?

Thank you in advance for your help.
Smiles,
Tracy

As an American with a spousal PR app in process, you would most likely be fine entering without a return ticket. If you wanted to cover your bases, you could purchase a separate, fully refundable ticket back to the US.

No, you cannot apply for a work permit. You have a Visitor Record, not a TRP. A TRP is a special permit granted to those who have a compelling reason to enter Canada but are otherwise inadmissible for reasons such as a criminal record, medical grounds etc.

canuck_in_uk:

I have a quick question. A friend have a IN-LAND PR application pending (spouse sponsor), her present status in Canada is visitor till September 2015. There is an emergency back home and she need to go home for her mother's burial. How can she go about this? What is her chances of being re-admitted back into Canada if she leaves for her mother's burial? What option is available to her from CIC if she has to go for this burial?

Thanks

Unfortunately, there is no option available from CIC and no one can guarantee that she will be re-admitted.

Thank you Canuck for helping me with my questions. :)

The PR app would be as a "common law", not a "spousal" app. So, with that I think it would be safer to obtain a return ticket. You just never know what each border agent will decide. ;D

Have a great day!!

Don't worry, they will not make any distinction between "spousal" or "common-law".

When we came to Canada in the middle of our app processing, my partner had a fully refundable one way ticket back to the UK just in case. The CBSA officer never even asked about a return date, let alone the ticket. Once they see that you have a sponsorship app in process, they relax the rules quite a bit.

Oh wow, that is great news. I would rather not have to buy a ticket.

Would I just show them the copy of my application or receipt so they know I have an application pending?
Also, do you think the length of time matters from when it was submitted. We will be applying in May, then I leave for my son's graduation in June and then will come back to Canada for the remaining time until it is completed. What are your thoughts on that? Do you see any problems?

Thank you so much for all of your help. This forum has helped me so much and I am just so appreciative.

Have a great day Canuck!!

You should be fine. Take a copy of the fee receipt and, if you have it by then, a copy of the sponsor approval. CBSA should be able to see the app in their system.

Just remember that you are entering Canada as a visitor to be with your partner while your PR app processes. Don't say "moving to" or "living in" Canada and don't show up at the border with a whole ton of belongings.

Common-law is when 2 people have cohabited in a marriage-like relationship for one continuous year.

You would not be considered Common Law unless you were actually living together in Canada for one year.
