My understanding of INLAND vs OUTLAND Spousal Sponsorship

Hello Everyone,

I am a Canadian Citizen who recently married a Japanese National on Dec 1, 2017 IN Japan. We are wanting to apply for PR and have been diving into the big question INLAND or OUTLAND application.

We would like the ability for my spouse to be able to get a work permit so we can be together... working while visa is processing HOWEVER, She would like the ability to travel back to Japan in case her parents fall ill or something happens to them. Please correct me if I state any incorrect information below.....

IF we apply INLAND I understand we can apply for a temporary work permit and an extension to a visitor visa at the same time. The processing time for INLAND may be longer but is mitigated by the fact that a work permit and visitor visa status is being granted (which accomplishes us living together in Canada... and both working). I also read that it is better not to leave Canada during application processing.... this is where my question comes in. Is this based on individuals who have more strict visa entry requirements into Canada? As a Japanese national she can book a flight to Canada, show up and get granted a 6 month visitor visa on arrival.

So I wonder..... IF we apply INLAND.... get the work permit/temp visa extension shortly after application, could she travel to Japan in the event her parents got ill or something serious happened, without jeopardizing the visa application? If IRCC found out she traveled outside Canada would they deny it based on that?

IF we apply OUTLAND I understand the application goes to Manila, Philippines office... and seems to have shorter processing times than inland. Can we apply for a work permit at the same time as an application for an OUTLAND application? or does she need to wait until processing is complete to move here to work? With OUTLAND application..... she can still visit Canada? for up to 6 months? is there any chance of visitor visa extension with a pending IRCC PR Application?

Best case scenario would be that we apply for PR..... and have the ability to live together in Canada, and work in Canada while the application is processing.... with the ability to leave for a short time if absolutely necessary only (not for vacation or otherwise) without jeopardizing the visa application.

Thoughts? Recommendations?

An inland application can be denied if she's outside of Canada for too long (the premise of an inland application is that she's physically living in Canada together with you). There is also always some risk (although extremely extremely small for her) that she could run into issues re-entering Canada which would result in the inland application being abandoned. Again, unlikely this will happen.

No open work permit is available with outland. She will be authorized to work only once PR has been approved and she has come to Canada and officially become a PR.

Hello,

I would like to discuss and get inputs on my case for Spousal Sponsorship.

My husband got PR and is in Canada since almost a week. He is due to receive his PR card in April, post which we will be applying for Spousal Sponsorship. I stay in India and have been working in an MNC since past 6yrs. While I have been regularly reading a lot of forums, but I am still confused on whether we should go with Inland or Outland process.

Earlier the plan was that we apply for Outland Sponsorship, post which I apply for Visitor Visa and go and stay with him starting July until my PR decision comes through. I have a valid 10yr US visa and have also been to US lately, and will also provide NOC from my company, so I have full hopes that my Visitor Visa would not get rejected. But then I have been reading forms wherein I got to know that owing to the application getting stuck in NDVO, sometimes the PR decision takes 8-10months. In that case, I will then have to come back after the end of my 6month visitor visa limit which I don’t want.

So to address this, another idea that struck us was how about applying for Visitor Visa while on job, going to Canada and then applying for Inland Sponsorship? This way I can also get an Open Work Permit and don’t have to worry about sitting idle at home while PR is in process.

Now I have couple of queries if we go through this route:

  • Is Inland Sponsorship the best way out here?
  • Do I confess to CIC the intention of applying Inland in my Visitor Visa application? Because else they might find it odd that we haven’t yet put our PR in process yet.
  • Does this confession put my Visitor Visa at risk?
  • Is there any other imp point that I am missing here?

Would really appreciate some expert opinions on this!

Thanks!

Well, I applied for Outland only as with my husband being there and me not applying for PR from here would have raised a lot of questions.
So after due deliberation, I went ahead with Outland only as I did not want to jeopardize my chances of a visitor visa rejection.

Hi everyone, I live in brazil and my fiancee is canadian. We plan on getting married soon. I don´t want to stay home all day when applying for the PR inland. Is it possible to get first a student visa, go to school while the process is going on and after that get the PR?

Thanks everyone!

If you want to pay international fees. If you apply inland with a work permit you'll get an OWP in 4 months.

I want to put in my 2 cents. What is the policy that is ending this January for OWP inland applicants? What's changing?

If the pilot project ends then you will not be able to get a work permit even inland.
It is very likely they will extend the pilot though.

Okay. So if someone is applying within canada and the policy isnt extended, then applying"out of canada" while in canada is a no-brainer. Might as well have all applications go to outside visa offices. What will be the benefit of inland

Yes, I feel the same way.
Without the OWP it seems like the inland route isn't very attractive, processing times are roughly the same, you can appeal outland decisions etc.

But as I say, it's very very likely they will extend the project, they have done several times now and there is no reason to expect that will change this year (although of course there are no guarantees until they announce either way).

Okay I am just making sure I am not missing anything. Is that something they could announce before or after January 31st, the final day? Or is there no way to know.

Last year they announced the extension a couple of weeks before, so I'd expect them to announce it soon but there is no way to know.

Sounds good. Well I hope for the applicants' sake they extend it and if not, provide another benefit for inland applicants or get rid of it as a whole. We'll see! If you find out before me can you reply to this post?
