My son is in critical condition in toronto

I have a question and need some help in. See my situation is a bit hard to solve, I am currently living in the U.S. was brought here since i was 8 years old i am now 22, my legal status in process in the states but yet have no defenite answer and i was born in Mexico, but recently my son who is a canadian citizen was hospitalized after suffering internal bleeding in the brain and is in critical condition, now my son is living with the mother of my son in toronto and she is too a canadian citizen. Now im trying to go with my son in toronto but i dont know exactly what procedures to take i reached out to all the Canadian embassy in the U.S. but no one can really give me an exact answer as to what steps i need to take to get a temporary visa to get there. So i reach out to you who might have some valuable information that could help me. So my questions are what are my options, what steps do i need to take, who can i talk to. I am really in the need of help im desperate because i feel stuck, if you have any suggestion please dont hasitate any information is greatly appreciated

First of all, I'm very sorry to hear about your son. I hope he heals quickly.

You will need to apply for a TRV (temporary resident visa) to enter Canada. The information on how to apply is posted here:

However I think you are going to face complications qualifying for a TRV. In order to get one, you will have to satisfy Canadian officials that you will leave Canada once your visit is complete. Given you don't yet have legal status in the US, this is going to be difficult to prove. Also, do you have a passport (i.e. passport from Mexico)? You need a passport to apply. Finally, in the event you are approved for a TRV to visit Canada, make sure you understand what this will do to your status in the US before you leave. Depending on how you entered the US (i.e. legally or EWI) and depending on how long you have been out of status (assuming you entered the US legally), you could be banned from the US for several years if you exit the country before you obtain legal status.

Well i dont care about what it will do to my status here in the U.S that i have to give up, but the thing is that i dont know how long this process will take as the doctors tell me that there is brain damage. So do you know if there is some sort of humanetarian visa or something for an emergency type of situation? The reason is that when he does get better the doctors told me that he will need lots of therapy and that will take time lots of time i mean right now he is in a comma and we dont know when he will come out of it to begin with, it might take a month just like it could take years

I'm sorry. I don't know if there is any H&C/emergency visa available. I'm not aware of one - however one of the more knowledgeable members of this site might be able to help and will hopefully respond.

Do you have a valid passport at this time? If not, can you obtain a Mexican passport while in the US? I suspect having a valid passport will be mandatory even if you're allowed in for H&C/emergency reasons.

yeah i got the passport, now im just trying to get through the process but is so much that is a bit overwhelming and i dont even know where to start

what citizenship do you have? if you are a US citizen, you do not need any visa to enter Canada.

have you tried to apply for a visitor visa in the Canadian consulate in the US? is it possible for you to receive from his mother a letter-confirmation about your son's health condition issued by a doctor? it can help you visitor visa application.

Yeah i got everything from the Court transcript from the Ontario Court of Justice Toronto since childrens aid was called in to make sure it wasnt non-accidental related but when they finished their investigation i got all the transcripts and court file copies and i got a doctors letter with the condition which he is, the mothers too going to get a letter too signed by the other doctor that is in charged of my son. so as far as confirmations i got them

but are walk ins welcome at the Canadian Consulate? if so is that during the 8-12 times?

Check the "walk in time" of the Canadian consulate office you are going to. You should actually go early.

As of TRV (the link above), the person in Canada will need to send you by mail a invitation letter (signed and dated), bank balance statement to prove can support the during of your stay (stamped by bank).

You will fill out the form (from link above) and sent it to your local Canadian Visa Office. The wait time for me is approximately 1 week.
