Hi Seniors,

I got my PR under Skilled Worker. I applied as a Single Applicant. When I got to Canada they asked whether I am married and my civil status, I told them that i'm not married but I have a fiance but I'm not married. Then they asked why I didn't include her in the application and I told them bcos we weren't married and somehow they didn't seal the PR on my passport and couple of days later asked me to fly back to Sri Lanka and solve the issue with the embassy. I went there today she told me that you have to give details of a even a girlfriend if you have one and they will cancel my PR since it was missleading them.

Pls Help me. How can I appeal this decision? Is there something I can do?

Too vague post. Who did not stamp the PR? and how can you go to Canada if you dont have a PR on a PR Visa?
Fiance' is not wife. And you do not have to declare anything, unless legal documents exists. Common law partner is a different thing, and you have to prove that you live together, if you are claiming for points.

I am not very sure of the original posters post... seems wrong.

May be the Fiance has report a case in Srilanka embassy due to which Canadian embassy has sent him back for further clearance...But still a dicey one ..But how can canada embassy call him after 2 days only info at that time embassy has his address...
Generally girlfriend have not to be declared but your VO has said to be declared really tricky one.. ...In my opinion if the document of your fiance has some weight then they will make a case if there is no legal document i think embassy will not have a problem, in your case i think embassy has a concrete document to revoke your PR,

i found a form to mention all the addresses in application kit but i didnt find a form to mention all the girlfriends ;D

The girl is a finance not a girlfriend a merre girlfriend I hope you understand what that means if u hv lived with a girl for over three months in developed acountries like canada and usa they consider the girl your girlfriend so pls he gave a missleading information

Everybody should no that these people are looking for waus to deny visas

Seriously, people should stop posting bogus stories here or at least post enough information to allow others give useful advice. How can you be sent back over a fiancee with no legal document? You do know that you have to sign a declaration at least for common-law partnership? Can you explain where you were for the few days in Canada before going back to Sri Lanka? What status did you have in Canada then - illegal alien or PR?

While this is an open forum, let's try not to abuse it for the sake of others with genuine problems.

My PR application was approved and I got my VISA on May 16 th.

At my arrival in Vancouver I was asked the following questions

Are you married - I said No

Are you travelling alone I said yes

Are you single I said I have a girlfriend and we were living together from June (referring to the days I spent with her on my days off)

And also said I was in a common law relationship without fully realizing the meaning of it.

I was asked why I didn't mention this in my application I stated that I was not married to her and also hadn't lived one year with her. The officer said then why did you say you were in a common law relationship I said if you need to live for one year for common law relationship then I haven't.

when I told that how i am supposed to add my girlfriend when we only lived with her for 6 months the officer told that I should have assumed by the time i got my PR it will be one year I asked how I can be sure whether I will be with the same person and she said I am with her still.

My Passport was seized until she can clarify the situation with Colombo, and I was given a letter to enter the country.

Next day I was asked to come and had another interview and I was told I had two options That the officer spoke to the visa officer from Sri Lanka and the best option would be for me to return to and I would be able to add them to m y file or I would be detained and deported and also I may not be able to sponsor mygirlfriend ever.

I spoke to a supervisor afterwards and again I clarified I was not in a common law relationship and that I said the word without fully realizing the meaning of it I was again recommended to return stating that this would be the best option if I wanted to sponsor my girlfriend one day.

I returned to Sri Lanka and when to the Embassy and met a visa officer Upon my arrival I submitted my passport and she had it with her when she came in for the interview,She stated that my file is closed and they cannot do any amendments and that my visa is also cancelled and I will be banned for two years from entering Canada.

This might sound ridiculous to you guys and I think the same. But this is what happened. Can you advice me what to do about this?

Can I appeal this somewhere? Embassy or court or some other organization....

I think you have a fairly strong case here. Canada does not support forced marriages or partnership which is what the visa officers appears to have done in this process. They've clearly abused their powers if the events occurred as you've stated. It would have been better for you to fight this from Canada but unfortunately, you've succumbed to their intimidations and left already.

I will suggest getting a lawyer and filing the case in a Canadian court if possible. Do you have relatives in Canada? Are you absolutely sure you did not include your girlfriend in your application nor have any legal documents binding your relationship? The earlier you resolve this, the better.

No I did not mention her anywhere in my application. I am also regretting the decision I took to come back instead of fighting it from Canada. I don't have relatives in Canada but I have friends and I can find a lawyer If I can take this case to courts. Is it possible and will I have a fair chance of retaining my PR and how long do you think will it take?

You might want to write the visa office a long letter, detailing the events that occurred. Emphasize in the letter that you believe there's been an abuse of power and due process in the way you've been treated. Also point out that you've not been treated fairly. Your girlfriend was never part of your application for PR and you got all the qualifying points on your own. At this time, you've never applied to sponsor your girlfriend nor have you ever updated your application to show a change in your status. You're therefore requesting that your file be reopened and your cancelled visa restored.

You might want to run this letter through a lawyer before submitting. Even if your visa is not restored, you can make reference to the letter in any subsequent case you're filing. It's always good to put things on record while it's still fresh in your mind.

I agree that it is important to document this as soon as possible. Point form is easiest for people to read. Consulting a lawyer should be a priority. This sounds like one misunderstanding after another. All the best.

This is really unfortunate. Did you mean June 2011 or 2012 when you said you guys lived together? By the way, I think you did the right thing by returning home considering the alternative was deportation.

Very sad indeed, i second jadwig opinion of writing letter to your visa officer. If I was you, I would write a letter to Prime Minister Stephen Harpour and Immigration Minster Jason Keeny, their email addresses are available on internet. You can explain that english isn't your first language and you really didnt know the meaning of common law relationship and that you were tired and nervous at the same time. That will roll some heads hopefully.
