My permanent card will expire after 40 days and i am abroad , my wife is Canadian accompanying me and she is working abroad and i am still didnt finish my medical doctorate , i didnt stay the 730 days untill now ,, so should i come back now before my card expire and apply for a new one but i cant stay more than week at canada ...or after expire i can apply from Canadian embassy aT US ..i am confused and i dont know what i should do,,
plz advice me hero members ..

1. Most responders/ forum participants are volunteers so you may not always get a response in a time frame desirable to you. If you need an immediate response/advice then typically you need to seek that from a lawyer and pay the going rate.

2. The most important aspect of PR Card renewal is to meet the Residence Obligation. Type this in the search engine its been discussed endless times. The RO is typically met by being physically present in Canada. One of the exemptions to this is when a PR is accompanying a Canadian Citizen spouse abroad as you have where the accompanying days are classed as 'In Canada' days. You need to have a minimum of 730 days of physical presence and/or accompanying Citizen spouse in any combination in the 5 years prior to the date you sign the PR Card renewal application date. If you don't meet the RO don't apply for PR Card renewal or you will bring problems for yourself including the real possibility of PR loss.

3. The rules require the PR Card renewal application to originate in Canada. It doesn't mean the PR has to be physically present in Canada. Most applicants in your position mail it to family/ friends in Canada who then mail it onwards. I personally think its a waste of time doing this since the end result is the same but heck who knows what the legislators were thinking if its not mandatory for the PR to be in Canada. I expect it to one day though when they introduce biometrics collection for this process.

4. Your PR Card renewal application must make it clear you live in the US in the relevant sections.

5. CIC typically require out of country PR Card renewal applicants to collect their PR Cards in person. This so they can verify your declared passport stamps.

6. Some PRs depending on their citizenship and hence passport they carry e.g if your passport allows visitor free entry into Canada have no urgent need for a PR Card but wait until they are back in Canada for a visit etc to re-apply for their PR Card.

The Canadian embassy has no involvement in PR card renewal. It must be submitted to the Canadian CIC address provided.
