My partner was cheating on me and stayed to get PR. What can I do now?

My partner had recently received PR into Canada (Toronto) from Australia. He was cheating on me the last few months and waited to get PR when he broke up with me. Is there anything I can do to protect myself now? Or is there any way I can get him out? I feel used and cheated and this whole relationship was a scam. Can someone please give me some advice?

You can report him to immigration for marriage fraud if you have proof. However, it's not in your control what they will do about it if anything. There is no 2 year conditional PR anymore for sponsored spouses. It's basically sponsor at your own risk.

I am not 100% sure what that means? 2 year conditional PR? Sponsor at my own risk, as it now I am just legally responsible for this man for the next three years? I just want to protect myself, but more over, I really want them out. I am guessing the chances are pretty slim when it comes down to this....

Up to a few weeks ago, he would have got "Conditional PR" status meaning if you broke up within 2 years after he got PR you could report it and would be a good chance IRCC would revoke his PR status.

That rule was recently removed, meaning you are most likely out of luck.

You can report that he engaged in immigration fraud to obtain his PR status, but I'm sure he will just say the relationship naturally broke up shortly after he landed as a PR. So if you can submit any proofs he in fact had no intention to continue the relationship (such as him cheating) and just used you to get PR, submit it to IRCC when you report him.

It's entirely up to IRCC how much they investigate or if they make moves to revoke his PR status... or simply allow him to stay here as a PR. If the latter, you are unfortunately on the hook for any social assistance (welfare) he receives for next 3 years.

He told a friend of mine that he was planning to break up with me before this happened. I know he was met someone else, and during that time, they were getting to know each other. right after the break up i told him to move out. They moved in less than two weeks later. Doesn't it seem odd that they within such a short period of time, they would move in together if he never cheated on me?

It may be odd but it's not definite proof. If there is nothing written, it may not be enough for immigration to go on. Even if there is something written, it's still not under your control what immigration does, if anything. You can report it and that's it. Immigration may decide to talk to him and he will say that you are lying and that you did not break up until after he got his PR, that he never cheated on you and that the other girl he moved in with was just a friend who offered him a place to stay when you broke up and later became romantic. Immigration will likely decide that it's not enough to go on and leave him alone.

I'm not saying you shouldn't report it. Just that you shouldn't get your hopes up that something will actually happen to him. In my opinion, go ahead and report him with the statement from your friend included. Then forget about him and move on with your life and hope he stays off welfare for the next 3 years.
