My open permit was refused what will i do?

Hi everyone.. I'm glad i found this forum. I'm in desperately need of help because of my paper was refused . I was under live-in caregiver and i entered here in canada way back september 15, 2006 and before the program was 3 yrs. but now they change it to 4 years which i wasn't aware. I submitted my application in september 2009, i was 7 mos pregnant at that time and i quit my job as i can't continue my program anymore because of my hardship. I lost 2 months to complete my 24 mos but the expiration of my WP was last month december 29, 2010. If i only knew that the caregiver program was extended to 4yrs i can still able to cope up with the remaining months that i've lost, i have look for another family to sponsor me because i still have a year validity of my WP.

The immigration wrote me a letter that they refused my application due to incomplete of 24 mos under live-in caregiver and i must leave canada after the expiration of my WP that was this december 2010. I found a family who can sponsor me again but the thing is i dont have status right now, can i be under restoration of work permit or what will be my case? need your help guys.. thanks so much and hope to hear from you soon..

You can submit a request for restoration of status, then start the LCP process again, if you have a family who's willing to hire you under the program. You will have to work 24 months in 4 years as a live in caregiver before you can submit your PR/OWP app.

Thank you job seeker. I wish i can still restore my status. Somebody told ne about humanitarian rights also. I'm so confused i dont know which one will solve my problem. I'm just so worried that i'll end up going home with my son and no future for us there my paper is so complicated. Aside from my papers here, we are petitioned by my fiance in us all our papers will be forwarded here if everyhing went well. My very concern is they might look my status at us consulate and i dont have nothing to give them. How heavy is my burden right now. I thank you for ur advice.

Oh my goodness ! I've never seen a caregiver begin denied OWP or PR , you are thé first person . You Will need to get a lawyer .

Hi Kaina,

Who is sponsoring you to where? You are out of status. But you have 90 days to restore your status. But probably not as a worker but as a visitor, then process your WP under the LCP, but you may have to send your application to the US to qualify under the program. Have you received a new LMO?

The family who's willing to sponsor me is still gathering info on how to get LMO. Also my fiance from US applied for our petition with my son. By the time i got answered from the imigration he start to petion us. I prefer here to stay rather going to US thats why i want to try again to restore and start all over again the LCP if given a chance and gods will. I'll do my restoration as u said and i'll wait for their response. Thanks so much job seeker at least im a bit at ease now. I wish i saw this forum before.

Application Process

Step 1: The employer completes the form “Foreign Worker Application for a Labour Market Opinion.” (PDF 285KB) - View as HTML.

The National Occupational Classification (NOC), which contains information on occupations in Canada, can help employers identify the proposed occupation, duties to be assigned, and the prerequisites for the position.

Step 2: The employer submits a complete application to the nearest Service Canada Centre that processes Foreign Worker Applications or online.

Step 3: Service Canada reviews the application according to criteria noted above, and develops a Labour Market Opinion.

Step 4: Service Canada sends a written letter with results from the Labour Market Opinion assessment to the employer, who then communicates the results to the foreign worker.

Step 5: In the case of a positive Labour Market Opinion, the employer sends a copy of the confirmation letter to the foreign worker.

Step 6: The foreign worker applies to Citizenship and Immigration Canada for a work permit, attaching a copy of the confirmation letter.

Hi job seeker, thanks for the info your a big help i'll keep you posted. One more question, if ever my restoration is ok u said that i can submit my application as LC in US is that right? But the problem how can i go at US i dont have a B1 visa as they canceled it because were supposed to cross the border of US when they knew that i dont have enough months of visa left here in canada and that time we declared what our relationship together with my fiance and they said i should not use my B1 visa as they know that We can get married there and i'll not gonna come back to canada so the IO at the border told me tgat im using the wrong visa and i have to get fiance visa instead which the paper is still on going. Do you think i can still or they may still allow me to enter the US if i want to apply my WP as LCP? I'm so very complicated with my papers.

You can send your application to the US but you may have to wait for your status. Bit tight.
