I have a 14 year old and 9 year old accopanying me to Canada. They have been crossing the border with their nexus cards, but they don't have passports yet. Their dad won't give approval. Please tell me thye won;t need them to land. I have passport. I keep reading about passport requests and I am anticiapting that request, does anyone know if I HAVE to have them for my kids to land? Thank you so much for your help. :o
 
I think you do need passports. Do you have full custody of your kids? If you do, you should be able to get passports without the fathers consent. If you don't, they will not be allowed to immigrate without the fathers permission.
 
I have a court order saying I can relocate the kids. I have been using their nexus cards for id so far. I will look into getting them passports, but even though I have full custody, they said I still need their to be there when we apply. Thanks for the reply, I hope your not right though.
 
They do need passports to affix the visa.That is the only place they will put the visa,you need to go to court and get the court to over rule.And have you applied for the PR process?i dont think you can without their passports.
Also you need court proof you have full custody,if the father has visitation rights you may be out of luck....you will also need him to fill in the form IMM5406 for immigration.
If he has any rights to the children he can stop them from immigrating.
 
Just to let you know in order for you to get the children their U.S. passports, you either have a full legal custody (I am sure you need to have a proof of that) or have their other parent sign the notarized consent form if they are under age 14 (?) unless s/he will be there when you apply for them.
 
Thanks for your replies. I take the kids back and forth to visit their dad. I am close to the border. I know I have to get him to court to sign a form saying I can get the kids passports. I found that out after I posted this. I will call my lawyer and get that done!

I had to get a regular passport before I could file and I hated that i Had to. I got a passport card to travel between US & Canada and didn't' like forking over $200 more for it (we expedited it).
Just so they could affix a paper to it. Blech.
