My gf was released from her employer last June because she was exploited and she's staying with me since. She's currently unemployed because i don't want her away from me,I am a Canadian and I wanna marry her, the problem is she's still married in the Philippines. My question is can she get a divorce here in Canada? She's only been here since February.. Pls help me :(

She had been brought to Canada with the previously agreed contract as a live-in caregiver which she had fulfilled but, she only received less than half of the agreed contract salary, until her time of release she has still never received a pay slip or proof of any tax deduction in Canada. She was paid in cash which leads her in a bad situation. She has a copy of the contract of agreement and they violated many terms.

There is no divorce in the Philippines. She can get an annulment but she will need to file a petition in court and the court has to decide if the reasons for the petition are lawful. This process can take a few months to a few years depending on the each case. She can consult a lawyer on how to go about securing a annulment while staying overseas.

Actually, if she has been resident in Canada for a year or more, she can apply for a divorce in Canada. It will be legal in Canada, but not recognized in the Philippines.
