Hi

I applied for PR renewal for me a my family and I am aware that We don't meet the RO yet but we had to. They asked me to provide further documents and I did then We had to leave canada. I received an email and was informed that our files was transferred to local office. What are the options now?
Will they call us to an interview?
How can we make it if we are already and PR cards are expired?
Can I withdraw the application at this stage (the last resort will be maintaining the PR status for the kids in future).

Please let me know.

As per my knowledge if you are one or two days short might not be big problem but if more than this better to withdraw your application, all depend on officer how he look your file.

If you are outside Canada and you have not met the PR Residency Obligation, there are not many options. Perhaps no options.

A lawyer may be able to help. Maybe. Only maybe.

If you could relocate to Canada that could make a big difference.

Thank dpenabill but can you please explain more? What do you mean There are not many options? What is the procedure in this case and what shall i expect from the local office? What can the lawyer do for me if I hire him/her and should I do this now or at what stage exactly?

I would appreciate all experts feedback.

It all depends on what you mean when you say you "had to" as in compelling reasons why you could not meet the RO (residency obligation) and compelling reasons why you had to leave after applying. Immigration may accept certain reasons as humane and compassionate grounds, for example grave medical problems of a family member you were taking care of overseas as well as proof of that or possibly serious medical problems of yourself, spouse or children.

They will also accept if your spouse is a Canadian and you and your minor children were accompanying your spouse. Or if you or your spouse were employed by a Canadian employer and transferred to a full time position overseas and the rest of the family was accompanying that person.

They will however not accept reasons such as not wanting to leave a good job overseas, not being able to find a good job in Canada or being concerned about your children's education. Having left will also be a minus point. Your application would look somewhat better if you had a decent reason for not meeting the RO but are now back for good rather than not meeting the RO and making a short hop to Canada to apply for renewal and then leaving again.

If you do not think you have a good chance at keeping your PR, you can withdraw your application and hope that will be it. This will reserve the PR of your children. However, children removed as minors applying for travel documents at the age of majority use to have really good chances of getting them. However, this has been changing recently and now it is getting more common that they are denied, especially if they never really lived in Canada and therefore do not really have ties to Canada. However, it's worth a try.

You can hire a lawyer if you want to and they may give you ideas about angles to use for your appeals but it's no guarantee. A bad lawyer can even hurt your case by giving you the wrong ideas about appealing and may keep your hopes up and keep applying for you to line their pockets even if you don't have a chance.
