You need to get sole legal custody of your child through the court system in your home country.

Hello
I want too but it takes a year to get the court decision and i think its too expensive to get the lawyer

I'm not sure you have any other options. Due to the Hague Convention, it must be clear you have the authority / approvals to bring your child to Canada.

Can you provide more details? What country are you from? Are both you and the other parent listed on the child's birth certificate? What custody agreement is currently in place between you and the other parent? What are the challenges you face in getting the other parent to sign? Is it that the other parent is unwilling? Or do you not know where the other parent is located?

My son is Illegitimate so under philippine law the mother have a full and sole custody. What should i do

This is why details matter. That is different and I don't think you'll need to go through the court system. I'm not an expert on this. Wait for someone else to comment who has the right knowledge / experience.

@melody .. I was in your situation a couple of years ago.. the father of my daughter doesn't want to sign any documents.. I waited for 2 years before he was convinced to sign. its my daughter who talked to him . BTW we were married but separated for 10 years already.
