Dear all,

I am currently in the USA with my spouse. She is doing her residency in medicine which will finish in the year 2019, while I am doing my studies and it will finish soon.

my CRS score is 438 for which I have included my wife I am just waiting for my ECA confirmation. I have this questions if anyone can answer these

1. Is it necessary that when my application is approved is it necessary that my wife should come to Canada with me?

2. Is that a good idea that she is not coming now with me so I just apply for myself and does not include her in the application?

3. If someone got his PR in Canada, what is the time frame that he has to be in Canada in order to validate his PR? How long he should stay in a year and how long he can go out of Canada? What if someone is staying in the USA after his PR?

I am no expert but...

You can always show as "you are married" but spouse is not coming with you. This is very common. But you need to mention it.

Let's wait for experts to reply.

1. She does not have to come with you, however, you need to include her in your application as a non-accompanying spouse, this has to be on record with IRCC because of the future, in case you want to bring her to Canada.

2. It does not matter if she is coming or not, just make sure she is mentioned in your application as your spouse.

3. Once you receive your PR, you need to land in Canada before your medicals expire.

To maintain your status as a permanent resident, you must live in Canada for at least two years within a five-year period. During this time you must be here physically.

The two years may not need to be continuous. An officer can confirm if your time in Canada counts when you:

  • re-enter Canada, or
  • apply for a permanent resident card.

When she completes her medical residency, you can file a spousal application for her to join you in Canada, she does not have to go the Express Entry route.

Depends. You can do some math. As I see you have 2 options:

Option 1: You add her do your EE as an accompanying spouse, she has to land at least before the medicals expire (which is normally one year). So let's say you take your medicals in July 2017. She would have to land July 2018. She could in theory return immediately to the US. The PR is valid for 5 years during which you must be in Canada for at least 2 (details here http://www.cic.gc.ca/english/newcomers/about-pr.asp). So if she lands in July 2018 and returns to the US until let's say December 2019, she was away from Canada for only 1,5 years after PR. So it shouldn't in theory be a problem.

Option 2: You input her information as a non-accompanying spouse and only you will get PR at this time. Later she will need to apply for PR using the spouse sponsorship program. Just beware that spouse sponsorship can take 1 year to be processed. So you can think of applying before she finishes her residency.

Just one thing: your EE score is not the same if you apply with or without spouse, since spouse's background is also scored in the first situation. You must take that in consideration as well.
