Hello Sir,

I need information about Child travelling outside Canada.

My wife and I are not divorced but stay seprately. My child is 12 years and Canadian Citizen. I am also candian Citizen But wife is not.

I have an apprehension that my wife will take away my child out of Country to India without my consent. I want to stop my wife BUT without involving POLICE. I want to keep away from Court cases as much as i can as we never approach to court in past and settle all issues amicably.

Please Advise which authority I should inform immediatly so my wife can't take my child away from me.

Oh so sad. But isn't the child hers too? Does she at least have Permanent Resident status?I would suggest finding a mediator and going through Family Court. That way all you are talking about is your concerns, and it is less threatening for both of you. In order for your child to travel, he/she would need a passport and a written permission from you allowing the overseas travel or out of country travel. They're pretty sticky about it now, on the airlines in Canada. You check for yourself but, I'm sure you'll agree.

I thought to leave the country with the child the other parent either had to be there or there had to be a signed and notarized letter giving the parent permission to leave the country with the child.

I remember friends mentioning once that they had to go to a notary and have that done, because when visiting the child's great-aunt the mother would often cross the border to go shopping with the great-aunt and son. Since the father wasn't normally with them she had to have the notarized note, otherwise they wouldn't let her son leave the country just in case she was trying to kidnap him. Both parents were Canadian and they still had to have the notarized approval of the other.

I honestly don't know anything more than this, but you should try doing some research online at the very least. You might not like dealing with the legal system, but if you really are concerned that she'll leave with your child then you should call a family law attorney about it. If she is able to leave with him/her then you could have a very long, difficult struggle to get him/her back.
