My BOWP is been refused

Hi everyone,

I applied to renew my work permit last year but got rejected in November. The letter mentioned I had 90 days to restore my status.
in January I finally got invited to apply to become a permanent resident through CEC and because I know BOWP is an option to use when invited I did apply for it and paid my restoration fees.
I got rejected again because they say in order to apply for a BOWP a valid work permit is needed.
Now they want me to leave the country since I don’t have a valid status. but I still have my permanent residence application in process

what am I suppose to do then?

Apply for PR does not mean immigration status. Apply for a tourism visa is the only way to stay I guess. The bad thing is you cannot work until you get the PR card.
If you have spouse holding study permit/work permit or Child holding study permit. I guess you can apply for open work permit by their status.

thanks for the reply , what if I just stay until I get a response, will that affect the chance to come back in case that I get rejected?

You need to have a legal status in Canada when you receive your PR.

Why was your application for a work permit rejected?

If you need to leave then it's not the end of the world, but staying without a status means you are at risk of receiving a removal order.

If that happens, it will complicate your application. Then you have to apply for an authorisation to return to Canada if it becomes deportation order..

It's better to leave and come back once you get your PR application approved. Your previous refusal of the work permit and BOWP will not count against you in your application if you disclose them.

I'm worry maybe this may cause you illegal stay which is very bad for immigration record. You need a status in Canada. I feel if you apply for tourism visa it will be safer.

I would never do this if I were in your situation. Under CEC you have a very high chance of getting PR.

If you drop out of a valid status and overstay and then are called up for "landing", you might get into serious trouble.

You need to leave Canada. You have been here illegally for almost 6 months. You will not be approved for PR with no status.

Well, you don't qualify for a BOWP unless you have a valid work permit at the time of application. Since your permit is expired you are not entitled to be in Canada. If anything you are likely to having your PR application refused for being in the country illegaly.

Having filed your PR application doesn't grant you any benefits, you've clearly done things wrong.
