my American friend just apply inland family sponsorship

Anyone knows what is the lead time for INLAND American sponsorship in Jan 2017? My friend just apply her PR (she's American & have a 5 yr old gal), I didn't know till she apply inland orelse I would have advice her outland.

She plan to visit her family in the state during summer time for 1-2 months, being that she apply inland, will there be an issue?

IRCC is saying 1 year for inland but no one knows at this point if that will happen.

Yes, there could definitely be an issue if she leaves for that long. A requirement of inland is that the couple be cohabiting in Canada throuought the process.

Dependents often cause extra time in processing too, so there is a good chance it could be over the 12 month goal.

Where did you get that from? Having a dependent child included in the app doesn't cause extra time; kids are easy, no security or background checks.

I can see delays happening if custody issues are involved. But that wouldn't in general be the fault of IRCC, except in that they'd be asking for proof or giving instructions that were difficult for the applicant to comply with.

Yes, delays happen in those situations and when the dependent must be excluded. But such situations are not common and as you said, are the fault of the applicant, not IRCC.

I've heard many personal stories of it...yes most if the child is unaccompanied, but several included as well. Just wanted to through it out there so they know it can possibly take longer. Hard to say what IRCC will classify as the more complex cases to equal the 20% they see taking longer than 12 months.

My apology for late clarifying, her daughter holds dual citizenship (US & Canada). She and hubby know each other over a decade but only decide to get married in 2015 jun. As she doesn't know she can apply under common law spouse.. now their relationship is straining and she is even thinking of leaving but her application still in process. She wonder is there any free marriage counsel or legal aid for someone still in the process of PR?

I guess maybe I used the wrong words, basically, she would like to ask based on her visitor status, can she get any help (marriage help) to get a better understanding if she decide to separate from her spouse. But her application still in process however, her spouse did have a record of assault towards her and their child.

I dont understand, is she looking for marriage counseling?

As an aside question, has she contacted the authorities about the assault on her and the child?

Which authority are you referring to? The police does know and have record of his assult but she did not notify cic.

If she separates from him, the sponsorship application will be cancelled. If she goes through the process even if the relationship is over, it will be misrepresentation.

He assaulted her child and she is still with him? That is seriously screwed up.

The police I meant. So yes, you answered my question.

Is she or the child in danger by being close to him?
I'm no counselor, but if this individual assaulted her and her 5 year old child, she should probably stay as far away from him as possible.

As mentioned before, if she leaves him and goes through with the process, her application will canceled once she notifies CIC, or its misrepresentation if she doesn't notify CIC.

They have been together over a decade (10 yrs), jus recent years especially economy downturn, he drank more till drunk n sometime get violent but as a spouse especially women, we often "hope" their man will change and try and try. There are no perfect marriage.

They did not apply for her PR and she doesn't know much about immigration hence been dragging her feet until lately and I only happened to know her after she send in her PR application. As they both have a child together, she is not trying to get PR for own gain and have intention to move back to the states closer to her family but since their child is young. She might have a problem leaving unless there's permission from her spouse, no?
