i received the caq and the study permit for 2011-2014 for a bachelor degree in montreal. when i renew in March 2014 the caq was refused due to my low gpa. So I was not able to renew my study permit. However I stayed in canada until may 2015 applying to new school in toronto but i didnt work or attend courses. After my departure i received admission for york university in toronto. When i applied for a new study permit in my country in haiti with this admission it was refused in sept 2015. i applied again this time nov 2016 in paris (with legl resident status) with a letter of admission of york university for jan 2017 the permit was refused again the reasons are still the same. (You have not convinced me that you will be leaving Canada at the end of your stay. To arrive at this decision, I have taken into consideration several factors, including: (Your previous travel, Immigration status in your country of residence The reason for your visit Any violation of the conditions of admission for a previous stay in Canada.

There is no mention anywhere that I have a ban on territory or expulsion ordered. I have no criminal records in canada or any other country. So I write to get more precise information and help with my options to start the processes applicable to my situation to restore my precarious status with Canadian immigration legally. i want to know if i should submit (An Application for aAytorisation to Return to Canada (ARC) // An Application for a Recourse with the Consulate // An Application for Rehabilitation of Status)

ARCs are for people who are inadmissible to Canada - this doesn't fit your situation. Same goes for the restoration of status - this is only for those who are still in Canada. It's really just a matter of putting together a stronger application and it's quite possible you may have to wait a few years before you reapply.

Have you obtained your case notes? These will provide more specific reasons why you were refused.

I believe what's probably working against you is the fact you remained so long in Canada once your study permit was refused. This was an overstay and an abuse of your visa privileges. The fact you disrespected immigration rules in the past means CIC is reluctant to grant you another visa.

Whoa ! I don't think CIC refuses extensions because of low GPA. I once had a friend extend his permit with a gpa of 4/12. Damn! What was your gpa ?

Ive been reading all sort of things online nothing really seemsto apply to my situation. I understand staying 14montha past my visa expiration was a stretch but I'm haitian at the time there was a moratorium stating that haitian with no status would not be deported they had until june 2015 to restore their status in canada or back home. That's why i left in may 2015 to restore my status home thinking it would be quicker that way and that's why i never got a deportation/expulsion notice

The fact that IRCC was not deporting Haitians at the time does not in any way negate the fact that you stayed illegally for 14 months.

I want to regulate my situation with the canadian immigration. If i don't have a deportation/expulsion notice what should i do to fix my inadmissibility, what are my options? i want to know if i should submit (An Application for Autorisation to Return to Canada (ARC) // An Application for a Recourse with the Consulate // An Application for Rehabilitation of Status)

Again - the ARC and Rehabilitation don't apply to your situation. There is nothing you can submit to regulate your situation.

The only way to regulate your situation is to provide much stronger ties to your home country when you apply for the study permit again to prove you have no plans on remaining in Canada long term and won't abuse your visa privileges again. To do this, I would suggest you first of all apply from your home country. Secondly, you'll want to demonstrate strong ties to your home country such as property, employment, other assets. Given your overstay was long and quite recent, I recommend you wait a few years before applying for a study visa to Canada again.

1. It was Quebec that refused the CAQ (required for Int'l students) not IRCC, no CAQ no study permit.
