Hi experts,

I am an immigrant and a PR holder under SINP OID category. I moved to Saskatchewan, Canada recently with family but due to some family issues and all - I am planning to move to Calgary after 3~4 months. I know this question has been raised quite a lot of times in different forums...but I seem not to find any definite / concrete - answer / case in this regard. Has anyone of you have any idea / suggestion for me in this regard...??? I am quite obvious regarding the "Moral Obligation" thingie...!!! but my situation is quite a bit above the line of moral obligations....:p then again...I don't want to end up in a situation where I face issues at the time of my citizenship. Pls suggest.

Hi @mahinhossain
I am SINP nominated landed in July 2022 and return back to home country after softlanding. Next month I am moving to Canada permanently and considering to settle in Alberta. I see you were in the same situation and successfully applied for your citizenship. Did you face any issue while appling for passport of any other information you would like be helpful to me. Getting Job in Sask is next to impossible and moreover my Kids go for IB curriculum where in Sask IB is available but mostly in Canadian history and Arts which is no use to my kids. This the main reason I am considering not to return back to Sask as my priority are my kids education to be completed in an IB school

Straight from Canadian Charter.

"Rights to move and gain livelihood. (2) Every citizen of Canada and every person who has the status of a permanent resident of Canada has the right: a) to move to and take up residence in any province; and. b) to pursue the gaining of a livelihood in any province."

Hi,
I am not an expert in Immigration laws but I can share what I did when I moved and settled in Alberta. When I moved to SK, we were expecting our 2nd child and before I can get a proper job, he was born. Since we were very new to a country with no job and relatives, we were struggling to survive. I had 2 of my school friends living in Calgary. Even though we had full intention to stay in Regina, but with the struggle - I then wrote an email to SINP stating my situation and asking them if we can move to Calgary so that my family gets a support and I can concentrate on finding a proper job. They replied immediately accepting the fact that I am a PR and have the right to stay anywhere in Canada. I'd suggest you do the same and explain why you want to move to Alberta. That will omit the surprise at the end....when you apply for citizenship. Best of luck....!!

Depending on how long your spent in SK the bigger issue is potentially your wife and child not meeting the residency requirement to qualify for provincial healthcare in SK not freedom of movement. To qualify for healthcare in a province there is a residency requirement. Typically the residency requirement means that you were a taxpayer in the province so contributing to funding the healthcare system in that province.

As a PR, you can live anywhere in Canada.

Hi, Thank you for your response. I read about that I can live anywhere in Canada, but since we got PR through OINP, so aren't we supposed to live in Ontatrio for 2-3 years first, the course I want to study is in British Columbia, so what will happen then, when we renew our PR or apply for citizenship afterwards ?

Why keep asking the same question? You really won't get a different response.

Canadian Charter supersedes it all and honestly IRCC could care less. You talk about living in a province which sponsored you, meanwhile people claim asylum and reacquire passport of very country they escaped from without any consequences.

Once again, straight from Canadian Charter:

"Rights to move and gain livelihood. (2) Every citizen of Canada and every person who has the status of a permanent resident of Canada has the right: a) to move to and take up residence in any province; and. b) to pursue the gaining of a livelihood in any province."

Zero impact on your citizenship application because all you are doing is exercising a right guaranteed by the charter.
