Mother's Multiple Visit Visa application refused

Dear All,

Myself, wife and kid have Canadian immigrant visas and we will be landing in Canada in Feb-2013. We are Pakistani nationals and are resident in Dubai, UAE. My mother (Pakistani national) is also staying with us in UAE as resident on my sponsorhip.

My wife is expecting and would be delivering in Canada after few months of landing over there. I had applied for my mother's multiple (TRV) visit visa so that she could look after my wife for 3-4 months. However, her visa application got refused since Visa Officer was not satisfied that she will leave after end of her stay in Canada.
The VO pointed 4 reasons,

1. Family ties in Canada and in country of residence (I had provided relationship info and have one relative in Canada, and provided mother's property document in UAE)
2. Length of stay (I had provided mother's return flight tickets)
3. Purpose of stay (I had provided doctor's letter and wife's medical reports
4. Answers were not provided truthfully (Not sure why ???)

I had even provided hotel booking for 2 weeks, and mentioned that would search accomodation in mean-time and would move over there.

Please advise how to overcome above issues, and should I re-apply? If not then what options do I have?

Refusal item #1 means that she has too many strong ties to Canada and insufficient ties to her home country (Pakistan).

Refusal item #4 likely means they think she wants to remain in Canada long-term and is coming for more than just a visit.

You can certainly re-apply. If you do, work on providing as much proof as possible that shows she has strong ties to Pakistan and will return there after her visit to Canada.

To answer your questions about other options - right now the TRV is her only real option.

To sponsor her under the super visa, you will first have to establish yourself in Canada and obtain a job that meets the low income cut off minimums. And even then, there's no guarantee of approval.

Thanks Scylla. To prove ties to Pakistan, in relationship information I had mentioned that my mother has 1 sister and brother in Pakistan, and I also submitted allotment letter of a property in Pakistan besides bank statements of Pakistan. Would appreciate if you could give some tips as to what else should I submit for Pakistan ties.

The problem is that she doesn't live in Pakistan.

Refusal item #3: There is not enough evidence why your mother need a multiple TRV just to look after your wife for 3-4 months. Shouldn't she just apply for a single TRV instead?

And then by saying "I had even provided hotel booking for 2 weeks, and mentioned that would search accomodation in mean-time and would move over there" seems to me that your mother intends to staying rather than merely visiting Canada.

Why don't you just wait until you have landed and have a home in Canada that accommodates to your needs, and then invite your mother in Dubai to get a single TRV for visiting Canada and look after your wife and new-born?

Yes I do agree with you on accomodation part. I do have relatives in Canada where we can stay for some weeks, but that may also go against my mother's application due to Family Ties issue.

The reason I am applying for her multiple-visit visa is that she will be alone, and having multiple visit visa will atleast allow her to visit me and my family multiple times for next couple of years (depending on visa validity). The problem with single entry TRV is that even if it gets approved this time, but in future there's no sureity that it will get approved next time.

But again this reason also put your mother's family ties in Canada stronger than Dubai or Pakistan.

Even though there's no guarantee that it will approved next time, but at least she would have a past history of traveling in Canada.

Hi Steaky and other Members

Thanks. Regarding stronger ties to Pakistan, would it be a good idea to ask my uncle (mother's brother) in Pakistan to provide a supporting letter indicating that over last 6 years she had been travelling frequently every year from Dubai to Pakistan and had been staying with them, plus he can also mention that my mother can stay with him and his family once I immigrate to Canada along with wife and kids.

Plus, I can also attach the exit / entry stamps (between Dubai & Karachi) from mother's passport. Please advise whether uncle's letter and exit / entry stamps would help. Or there's more that I need to provide.

You don't apply for multiple entry visa the first time. It's risky. You should go with single entry the next time.

Thanks for response. My mother was granted a single entry visa in 2008 though we had applied for multiple TRV. But this visa was granted in second attempt. After that in next 2 years we applied twice and got rejections, and now this year we had another rejection. When my mother went to Canada to see visit her brother and his family 4 years back she had returned after 3 weeks.

However, I feel CIC has not really considered this travel record. Anyway thanks, I will try single entry application next time.

Your mother can apply for multiple TRV but you or she would need to provide valid reasons (why she need a multiple instead of single TRV) and at the same time would not weaken your mother's ties with Pakistan and/or Dubai.

If you want to use the same reason (that your mom is all alone and at least she can be with you for next 2 years subject to passport validity), you/your mother might have better luck if your mother apply the super visa once you have established yourself in Canada.
