Hello Everyone,

I have applied visitor stay for my mother-in-law as we are new parent and we need the help of her with the baby. We got a rejection and the reason for the rejection is " [X] Immigration legislation requires that you and your accompanying family members if applicable, complete medical examinations as per R30(1) of the Immigration and Refugee Protection Regulations. Medical examination instructions were sent to you with an accompanying Medical Report Form IMM 1017 on: 2022/11/13. You were required to undergo a medical examination within 30 days from that correspondence date. You were informed that failure to do so could result in the refusal of your application. As you have failed to complete a medical examination as requested, your application for a VR is now refused. Your medical results must be known before your temporary residence status may be extended. Do not submit another application unless the results of your medical examination are known. :

What is our option? Can we do the medical exam for her and resubmit the application? How ca we do medical exams without any letter please help us

It sounds like your mother in law is probably in Canada now without status due to the refusal. So she will need to apply to restore her status. She will need to get a medical done before she can submit the restoration application. I'm not sure how you do that without the letter. Wait for others to comment.

How long has she been in Canada? Have you applied for previous extensions? If medical as requested in 2022 she may the been out of status for a significant amount of time and no longer qualify for restoration.

We applied for a visa extension in 2022, but before the result was issued, she had already left Canada. Consequently, the visa extension was no longer necessary, and the medical examination was not completed as she was already in India. This time, she intends to stay, unlike last time when she left shortly after we submitted the application.

If she remained past the expiry she was required to complete the medical even if she left. Are you applying for a new TRV or how long has your MIL been visiting Canada?
