So it all started on 15th june, I applied through vfs jalandhar under general category for a four year degree program and application processing in chandigarh VAC. On 22nd July, embassy wrote a letter to me stating that "I am a fraud and that i have forged my 12th DMC (detailed mark sheet) changing my engish marks. For this fraudulent activity they even warned me of banning me from entering canada for a period of 5 years, though they gave me 30 days to justify." I received this letter on August 2 from vfs. But actually the truth is that i never did anything like that. I applied for re-evaluation in english and my marks increased. I was issued a new DMC but marks were not updated online, embassy may have tried to verify online. So, next day i.e 3 August i submitted a letter of explation in vfs with a mistake letter from CBSE and one from my school to support my explanation, however CBSE were reluctant to update my marks online. But i took this matter to higher authorities. I wrote a letter to PM, filed an RTI, wrote to CBSE chairman, enlightened the HRD(punjab) department with this issue and god knows what else. In the meantime, i got my DMC authenticated from ministry of foreign affairs and state education ministry and handed over the original DMC to vfs to hand over to embassy with another letter of explanation. Now, since the matter gained much significance in the mean time, maybe other suffering students may also be pressurising CBSE, finally CBSE updated the marks on 2nd September. So, on the very same day i filled a Case specific Enquiry form and informed embassy about the online updation of marks. Apart from that letter dated 22 july, i have received no update from embassy from 15 june to this day. My orientation was on 6 sept and classes start on 12 sept, the university refused to provide any extension and there is no option for deferring as there is only sept intake. Now this is the real problem, initially i thought that i should now withdraw my file and start a new application for some college in winter. However, i cannot do so because if i decide to withdraw then it will be considered as me surrendering for committing a fraud and in that case i will be banned for 5 years from canada and with such background will never be able to go to any other country. So this is my situation now and would like your suggestion so as what should i do now. I now sometimes even laugh on myself thinking if is this all even real?

Hire a good canadian lawyer to deal with your visa. It doesn't seem to be CIC's fault as well. You have been wronged by CBSE and you shouldn't be paying for it. You can sue CBSE for the harassment and Indian lawyers are not as expensive as canadian one's. All this will take your time and money but you should take action to teach the erring parties a lesson. I really feel sorry for you.

I think getting legal counsel is your best bet.

File a lawsuit against CBSE for sure because an entire year will now go to waste for you, which gives you a valid claim. This will probably drag on thanks to our legal system but don't let those bastards escape.

As for the CIC, hire a Canadian lawyer. He/She will probably file an access to information request on your behalf first and based on that send a legal notice to CIC. Since Canadian system is just and fair, CIC will probably reach an out of court settlement with you giving you a fresh start with a clean slate for your visa application with a new VO.

Thanks for your suggestions and i appriciate it, but i belong to a middle class family and cannot afford all the legal fees of lawyers, especially after paying the university fees and GIC. Its impossible for my father to bare any more expenses for now. All i want is to somehow contact VO and acknoledge him about my situation, you see my application is still open and not yet refused. I personally contacted the enrollment services of my university yesterday and explained them my situation and taking it into consideration they allowed me to join at a later date but also said that it's strictly not recommended and just because of the situation i am stuck in, they are allowing so. They gave me grace period of another 10 days and made clear that after that they'll not be able to help anymore. Now, since my marks are now updated, there is no question of fraud, they can directly be verified from the CBSE website. The only problem is how to let the embassy people know about it ASAP?

Right! That's understandable that you just wanna be done with it

Are you able to send case specific enquiries? Then send one enquiry everyday along with proof of extension and deadline from university

If you applied on paper, go visit the VFS and have them forward a written notification to the embassy as well
 
I have done everything now. I sent case specific enquiry, i e-mailed to embassy, i even faxed and couriered them with details of my case. I have contacted vfs but they simply sympathize and say "but we cannot do anything". This is it, and now the last date for dropping my admission is also approaching i.e 23 september and after that my first semester fees with freeze and will be non-refundable, which i cannot afford.
What should i do now, please help..!!!

Just 2 days left now. I'll have to e-mail the university atleast on wednesday to drop admission so to get fees refund as I don't want to take any risk and wait till exact deadline i.e friday. Lets see what happens.

So my September intake got missed but with a lot of requests to university, highlighting my situation where i cannot withdraw, the university did defer my admission to Jan, however they do not usually do so for international freshmen. I got my deferral on thursday as friday was last date for financial penalty. Exactly after 100 days, since I logged my application, i.e on friday i recieved a call from consulate general where my application is processing, they asked me if i have an official written extension and i replied positively, they very keenly replied that i send it to them AS SOON AS POSSIBLE, they repeated it DO IT ASAP. After disconnecting the phone when i recalled the conversation, i noticed they asked for extension and instead i have deferral. But anyways i mailed whatever i had i.e deferral letter. What do you guys think now? Please do reply as i am tensed.

Wow dude, that is amazing. It looks like your visa might be approved. :). I had the same case back in 2010 when I applied. My consultant filled my form incorrectly and did not declared my travel history when it's a requirement to mention all the countries you have visited for more than 6 months. (I visited UK). My application was stuck in process for over 35 days even when I applied under SPP. Then I had a hunch that something must've been wrong with my application and when I checked the copies of it, I later found out that my consultant totally messed everything up. Before I got received a notice that you did, I immediately wrote an explanation letter and then explained everything to them and sent my new application form alongside with my explanation letter to VFS. 2 days later, I got my medicals and the embassy also called me and told me to do my medicals as soon as possible.

So as far as I think, this is a good sign. Keep your fingers crossed and keep praying.

Now i hope everything goes well and god listen my prays. And @icecool222 bro in your case, how much time did it take for decision after consulate called? Though i have upfront medical and passport.

For me it took within 5 working days but that was a while ago so things might have been a little different now. Keep us updated.

No worries, Adeep. Once you get your visa, I would still advise you to write to Minister of Education and PMO (you can use PGPORTAL for online complaint) to apprise them of how you were at receiving end because of wrong done by CBSE. Government machinery in India is worst. Cheers.
