Most of the refusal cases i have read about are relating to work experience,ie you don't possess the experience / job responsibilities required under the NOC that you want to be assessed against. It clearly means that the NOC we are metioning is beinh thoroughly assessed aginst our experience / job duties that we submit in the form of reference letter. I am eager to know of any rejection case whose job duties perfectly match with the NOC job details but he has been declared overqualified for that experience. Please do share if someone has come across such a scenario.

I don't think it's possible to be OVER-qualified with regards the NOC description and duties.

The immigration officer assessing the application will be working to an operations manual, which will tell them that the applicant's job description and duties must match the lead statement for the NOC, and a substantial number of the duties listed. It also says that it does not define how many a "substantial" number is, which indicates that this is left to the discretion of the immigration officer reviewing the case.

I suspect they leave this part deliberately ambigious. Let's say there are 8 duties listed for the NOC. If a case is very strong (good education, strong language skills, plenty of funds etc) - then an immigration officer may be satisfied with only 3 out of 8 duties. If the case is more borderline they are probably less likely to show leniency when reviewing the duties. Generally most people feel that they expect at least 50% of the duties to match, but my suspicion is that an individual visa officer may set the bar slightly higher or lower than that - depending on the strength of the case.

Hi wayne...
I hope you can give your opinion about my case..
I am a London VO applicant,I submitted my application last Oct 15,2010.
I am a dentist by profession in my country but I am working as a Dental assistant for 10 years now in a foreign country but my job description and nature of work is of a dental hygienist, so I applied on the NOC of dental hygienist and submitted a referrence letters from my department head and supervising doctor stating that I am working as a Dental assistant performing dental hygienist duties...
My Ecas is still RBVO since March 26,...
What do you think wayne?
Thanks...
