Hi guys,
My brother applied for visa on March 21 from London, UK and did not hear back anything yet. He just got one online confirmation of his application from London Visa office on March 27. His salary is 15$ and Job title is Sales supervisor but not in food industry. His employer is in Edmonton, Alberta. Any idea what can happen to his visa app..is there any chance to get visa...How these new changes would affect application already in processing? I heard that there is a cap on low wage jobs now....

The effects of the TFW changes haven't really started to be felt yet but employers are going to have to start increasing pay otherwise they probably won't get a LMIA. Example of documents required "Job advertisements demonstrating an increase in the wages offered". If your employer offers a large salary increase I don't think you will have a problem explaining that.

What would happen to the application already in processing? I told you that my brother's LMO falls in low wage.

You mean, employer will have to get a new LMIA with higher wages and then re-apply for visa? Or he needs to wait for the decision on his application for now.

bhagat Unfortunately its all still very new so its difficult to answer your question without risking being wrong.

Will the employer re-apply under the new rules and fees if the application is turned down or the original application just returned and refunded?

Does your brother have a plan B?

we have not talked to his employer about it yet whether he would go for new LMIA under new rules or not, we are just waiting for the decision. But I will be taking to his immigration consultant soon to know the current situation.

We still do not know what should be the Plan B.

Hi paw339,

a decision has been made on my brothers visa application and he got refused due to following reasons
1. Travel history
2. Immigration status in UK
3. Purpose of visit

All 3 reasons are totally nonsense because no body can challenge him about his travel history, immigration status in UK and purpose of visit. He has excellent travel history as he has chenegan (euro) visa and travelled to Germany as well. He has never violated any law in UK since living there. He has been travelling to India back and forth.
Secondly he is currently on Post study work visa in UK which is valid until August 23, 2014. He has completed his business studies over there prior to that and currently working.
And he got a job offer from Canadian employer to apply for visa.
I have discussed with our Immigration consultant in Canada who filed his work visa and he said that we should go in to court and challenge visa office decision. What do you think about it? Anyway I am thinking about hiring a immigration lawyer here for appeal.
Please advise.....
