Mistake at Resident Calculator and Advise Needed

Hello

I submitted my application for citizenship in April 2014. I obatained the record of landing from Canada Border Agency in August. I came ot know that I have done some mitakess on my resident calcualtor. Instead of being eligible on April 19 2014, I am beng eliible on May 07 2014

I called CIC.

One said to write a letter and ad this additional and correct document. It my caused some delay to your application

Called anotehr time to get the right address to send the document, another agent said to withdraw your applicaiton and resubmit again. Its already been 3 monts of wait and now another 3 month and gather all the documents

Any Experienced and correct advise please. I Dont want mistake another time

Help wll be highly appreciated

if you have a file number

please use that number and send the corrected residence calculator print with that letter stating the confusion between dates.

if you do not have the application number make a copy of your PR card and send it with the corrected print of residency calculator.

sooner the better.

My application us still in sydney. Letter is on the way with the booklet

That's my point that to wait another 6 months
And arranging some documents again

The guy submitted an application before he is eligible. I think it is the responsibility of the applicant to know the dates of entry/exit not border agency.

At the end, he can do whatever he wants and risk having the application rejected during citizenship test/interview. if no problem, good for him, if not he was warned, but keep in mind, he jumped line, so what do you think is fair?

The issue of either the applicant discovering pre-test as you have of an error in their 'day count' or CIC at test where the error means you no longer have at least 1095 days of Actual Physical Presence (APP) is covered extensively on the forum but a major let down with the set up here is the lack of a FAQ. I'll keep it short and summarize it as:

1. If you have less than 1095 APP days then its up to CIC and CJ to decide if to give you a pass on the grounds that you are an applicant whose circumstances are so special and unique as to by pass the physical presence test - after all you get a 1 year buffer in the 4 year period. CIC, most CJs and most of the FC bench agree that 1095 days APP is the correct residence test so you do the math and figure your odds of getting through without getting bounced and this after a potential long haul RQ/ non routine process currently quoted as 36 months.

2. If you have at least 1095 APP days then the CIC/ CJ discretion is not an issue. If your days are provable and you meet all the other criteria you get to the oath.

Hint - withdraw and re-apply unless your new day count is now completely out of sync with 1095 days and you want to take a chance on the non APP residence test (CIC appeal this and mostly win at the FC).

Also, if citizenship ministry for whatever reason down the road, 10 years from now discovers that you applied before you were eligible, they will gladly take your citizenship thanks to the new bill , so do you think it is worth having this risk for waiting 6 months?

You should withdraw application as you were not eligible on 19th April. If you send Letter but how you change date on application ? So withdraw your application .

4. 2 or 3 with appeal and refusal plus re-application - who knows?

The 6 months to put you back in 1 (for GTA its 6-8 months) is the least painful option...especially as with 2 and 3 you can get bounced!
