Missing form IMM 5604

I visited Canada from Brazil. My Ex signed off for a year so my son could come with me. Now I have married a Canadian here and applied for Permanent Resident status but he will not sign form IMM 5604 and agree to my son living here unless we agree he can pay less child support. My husband is rich so he got the idea he doesn't need to pay as much now. My Ex doesn't even live in Brazil. What can I do about this? Do I need to go back to Brazil and get full custody? Or can I get custody in Canada, even if I am not yet landed. All very complicated. According to the paperwork I need to go back to Brazil soon or I would have abducted our son.

This might be an issue beyond the scope of this forum, I think you probably want to consult a family lawyer or something. It's more of a child custody issue than an immigration issue at this point.

I did consult a family lawyer and he said I needed to consult an immigration lawyer. Since I couldn't afford two lawyers I posted here.

For the purposes of immigration, you need the father's permission or full legal custody.

The custody dispute is a family law matter.

Again, that question isn't really something that could be answered by anyone here, unless there's a user with extensive knowledge of Brazilian family law. It sounds like you're in a really awful situation, and I hope it gets resolved in a way that is best for your son. I'm surprised that a family lawyer told you to speak to an immigration attorney, but I don't think this has much to do with Canadian immigration policy, and is more about family law in Brazil.
