Misrepresentation

Hi,
My friends made application as family for PR last year in Canada. Last month his wife and his son went his homeland. When she want to come back to Canada, she applied for temp. res. visa for herself and for his son. She made a mistake filling the form and Visa office sent a letter writing this is misrepresantion. His wife and his son (15 years old) are inadmissible to Canada for two years.

a)What is the status of the PR application of my friend? He is in Canada now. If he goes his homeland and wants to transfer his application to homeland, can it be a problem?
b) Because his son didn't fill and sign the form(hi isn't 18 years old), his mother is responsible of him. Why the boy is inadmissible to go to Canada?

What do you advice him? He is very sad. He doesn't want to stay in Canada without his family.

1) He can't transfer his application to his homeland. Whichever visa office he originally picked to process the application is where the application will stay until processing has been completed.
2) The application was for the boy as well as the mother therefore both are impacted by misrepresentation and the two year ban.

Thank you for your answer Scyilla. For example, if my friend goes his homeland and when CIC requests the passport, he sends it to me and I send it to CIC. After stamping the visa I send to my friend, can he come to Canada without problem?

If your friend(the husband) was not part of the misrepresentation what's he afraid of?

He applied as family. Because of misrepresentation of his wife, he afraid of visa office won't give him the visa to come back to Canada. Maybe they will find responsible the husband and they want to refuse the family. We don't know ideas of officers.

Your friend can apply for his temporary resident visa in Canada(send application to CPP-Ottawa if he has a valid work or study permit). Unfortunately for him, the PR application may be rejected since his wife and son are inadmissable(due to misrepresentation). Very sad situation.

I think your friend should in detail to Immigration department, Canada and one copy should be forwarded to province immigration minister as well as Immigration minister, Canada, completing explaining the situation and error. He should try to convince that there was no false intentions it was only a misrepresentation and he should accept the mistake, and try to beg the attention and the favour of the department

Infact the local lawyer's help can also be taken in this regard

Sunil, You say he has a chance. Are there somebody to be accepted to immigrate when he wrote the letter as you mention?

To be honest quebecois, I don't have anyone in the personal contact for an example. But I got this information from one of the Immigration lawyer. And atleast, when the things have ended, your friend should give the final go, reach the higher authorities and try to convince and explain them his innocence. He needs to convince that it was just the human error it was not the intentional fraud or anything of that kind. After all, the higher authorities are the ultimate decision makers. So I personally think that rather than to surrender to the situation one should fight it out at the best.
