misrepresentation of documents

Hello,
We submitted an application January this year and expecting a medical request this month but the CIC sent us an email saying that my wife fail to declare her daughter on her previous immigration applications which they say fall under misrepresentation of documents. Her daughter is not with us right now. Upon checking on all of her work permit applications before she became my spouse it says there that her daughter has been declared as her dependent. We are so confused if in which type of applications she fail because when she became my spouse, her open work permit was already under my name and the application for her work permit don't have anything that asks for her dependent as she is not the primary applicant.
Is there any member of this forum has the same issue as ours because we don't know which type of response that we need to make and which type of documents we need to submit to them, we are just given a certain period of time. Please give us some advice..

Was she included in your wife's Family Information?
Did you include the daughter in your application as a dependent?

You should have included her daughter on your work permit application as a dependent. Did you list her daughter on your work permit application?

It's good that they didn't refuse your application right away but gave you time to explain yourself (I guess you received "fairness letter"). In your case I would find a lawyer who can prepare response letter explaining your situation.

From what I know -
It is not needed to declare or add dependents on Work permit application.
I have never added my daughter's details in any of my visa application.
She has always had her own application

What is needed is to declare all your family members in the family Information Form - Whether accompanying or not accompanying with you to canada

My wife's daughter is in the Philippines and yes she always include her daughter on her family information as she was her only dependent even after we got married. I don't know if I have to include her on my work permit application because the agent who are assessing our papers never ask me for any child dependents even in my own son..The agent will only ask for my wife's information for the application of her open work permit.

Hi

This seems simple if I am reading this correctly.

CIC are aware you wife has a dependent daughter that was not listed on your CEC PR application (I assume this is what you are applying for as you don’t make it clear). It does not matter how they are aware but they obviously are.

All dependants regardless of whether they are joining you need to be listed, you can choose to have them included as part of you PR application or not but CIC still need to know about them.
I would seek legal advice.

I included my stepdaughter on my PR application,.the CIC email says that my spouse failed to declare her daughter on her previous immigration applications and we don't know what was the application that they were talking about because we check all of my spouse's previous immigration application right away and we saw that she declared her daughter on each and every application she made. The only time that my spouse did not mention her daughter was when after we got married we applied for her open work permit(spousal visa),the application didn't ask for any child dependents from both of us.

Please let me know if you have any suggestions that could be of any help to us before we go to the lawyer, as we know that lawyer's fees costs a lot.

Problem is they know, and they checked this by looking at previous documentation.

I would seek some professional advice.

Do you have copies of all the other application forms you filled in?

I don't have all of it only few. We try to secure some of those forms from the agent who process it but some of them refuse to give us the copy.

When does your wife apply for her work permit before becoming your spouse? And when does she apply for work permit under your name?

Hi Colrainwx1985,

My wife applied her first work permit 2011 through a representative then she came to Canada July the same year, then she got renewed a year after by another representative. Then we got married Sept 2012 and we applied for her open work permit right away through another representative.
