Well, after my J1 visa expired I applied for B1 visa. So I’ve overstayed for 2 years. I’ve been meaning to apply for asylum here but I’ll be difficult under current administration.

And you are still staying there? If you had overstayed and come back, still you could have tried justified it though would have been hard without a valid reason, how will you justify now that you never left that place.

I’ve paid my taxes throughout, never been in trouble, been a good worker, have good references. I won’t be able to go to Canada even if I came to US legally?

actually in the PR application they only ask if your visa was refused, not if you are staying illegally. so technically you can apply. but im not sure what would happen during a background check. if i were you i'd apply and see what happens. applying is not illegal.

You may have come legally but you overstayed. Canada and US share immigration data so they would know immediately that you overstayed.

But I’m looking to go to Canada not on a work or student or visitor visa but I want to migrate to Canada, so overstaying in US will be a problem too?

You can apply for PR. Provided you are 100% honest in your application about your immigration history - you should have no issues being approved.

If you apply for any sort of temporary visa (work permit, study permit, visitor visa) you can expect to be refused.

If you want to move to Canada, focus on applying to immigrate.
