Yes, your husband can avoid asking you about it. The custody document is considered a solid proof.
You may approach him ahead of it all and give him permission for medicals, provided you want your child to be sponsored in future.

Just the custody document and a signed notarized affidavit that I cannot reach her was enough as a proof.
They never asked for evidence of communication.
 
Hi! I applied for conjugal sponsorship. My partner has 2 non accompanyinh dependants. 16 and one that just turned 18. They both had medical exams already. The ex partner was cooperative at the beginning but later on they had misunderstanding of my partner over the kids. So she sent her sister and mother to take the kids from the custody of my partner. One of the dependants has a medical problem and is currently being treated and needing further tests at the medical center. But the kids and the ex’s family are no longer cooperating. My partner had sent messages already but they are refusing to cooperate any more. What would be the best action for this? Shall we write a LOE to IRCC stating that we are removing them from the application and will no longwr sponsor them
In the future? Please. And if there is anyone here who has almost same situation i would greatly appreciate your help. Thank you
 
Hello. You need to write and submit a Statutory Declaration of Intent that states you realize you will no longer be able to sponsor the kids. It is CRUCIAL you also save and submit copies of any emails text messages, etc..any time you have had contact in regard to the medicals, so IRCC will know you have tried. They want you to try your best, but they understand that, sometimes, this isn't possible. However they need documentation. NOTE: The Declaration needs to be signed and notarized by someone with authority to do so.
