Medical for non-accompanying step child

My husband has a minor daughter from his earlier marriage. We have filed application for PR with her listed as non accompanying and submitted LOE for non-availability of her medical result since her mother refused. Now I'm asked to provide evidence of my husband's attempts to convince the ex to send the child. Not sure how I can prove this.He has approached court for custody document find is likely to get one. But the ex has refused to send the child for medical. Anyhow is really impossible to undergo medical exam for my non-accompanying step child.

Has anyone had a similar experience? Please help. Hope I can get ideas from you.

How did he contact his ex? Does he have emails proving she has refused to take the child to the medical?

Let them chat in skype and have all conversations be screen shot and send that as one of the documents. And let the mother give a letter that she is not allowing the child to do medical. Then have her notarized as well.

I have got a case like this before and I will send you some information like quote from CIC decree. Good as u have declared that and u can win by quoting decree which state u any accompany dependent failed to do medical cannot be sponsored in the future.

The ex does not use email/Skype. We only have phone records... that too calls to her father's number as she never picked up calls. We also have an affidavit from her stating refusal to send the child for medical.

That is something you should have mentioned upfront.

Have your husband get a notarized letter stating that he understands the child will be excluded from the Family Class and can never be sponsored. Along with the ex's affidavit and proof that she has custody, you should have no issues.

He needs to get every text he sent trying to convince her and send it to cic.
Also proof that he does not have custody

I am in same position. I have sent emails and letters to ex-wife regarding requests for the medical but she hasn't responded. I submitted all these to CIC along with custody order. But they have asked again for the medical not sure what else I could do. Any suggestions will be helpful.
