hi everyone , i need help!!!
I am being sponsored by my husband who is a Canadian citizen. I have a son who will be 18 soon but does not want to emigrate with me.My ex husband has full custody.
Does he have to have a medical, even though he does not want to go with me ?

In theory, yes he must IF he is on your application as a non-accompanying family member. However, as your ex has full custody, he could formally refuse permission. As your son will soon no longer be a minor, he could also refuse. You would have to inform CIC of this. It would just be a lot easier all round if he did the medical.

If he doesn't do a medical, he will be declared ineligible to be sponsored under family class so can never immigrate to Canada with you as a sponsor if he changed his mind and wanted to in the future. As long as you apply before the rules change in Jan 2014, I believe (not 100% sure) he would still qualify under the current definition of dependent which is under 22, or even over 22 but in full time school.

CIC will allow you to not get him a medical, but you need to include a signed letter stating you are fully aware this will make him ineligible to be sponsored in the future.

In general its best to get him to do the medical and keep the options open, since you never know what will happen months or years in the future.
