I’m posting this on behalf of a friend who is currently in a tricky situation and could use some advice.
My friend applied for Canada PR and has recently completed their medical exam in India. In fact, they received the "Ready for Your Life in Canada" generic pre-arrival email, but have not yet received the Passport Request (PPR) or Confirmation of PR (COPR).
Unfortunately, right after the new medical, their car was involved in a minor accident in India. There was no rash driving, and it appears to be a shared fault situation. No major injuries. However, the other party (a girl on a two-wheeler) is now demanding a high out-of-court compensation through her family.
My friend is not comfortable paying such a large sum for a settlement because it was not entirely their fault, and now they are wondering if going with process of filing FIR or court will impact immigration application at this stage (the other party might file an FIR to put pressure on them)
The big concern is:
If an FIR is filed, even though no charges are proven yet and there's no conviction,
Will it affect their Canada PR approval or landing later on?
Does IRCC check again for police reports during landing or before issuing PPR?
Any insights from people who have gone through something similar—or legal experts familiar with IRCC background check policies—would be really appreciated.
