Hi,

Please help me. I currently live in US and applied for visitor visa to Canada last week and want to go for my H1B stamping . In IMM5257E application form i stated as Single although i am married(Register marriage). But he lives in India he never came to US we are never together after our marriage. So does it will be a problem for my visa or when i enter into Canada? or should i reapply ? what are options ? PLEASE HELP.

Hi,

Regardless of whether or not you live with your husband, you must declare your correct marital status. For all purposes (visa and otherwise), you are legally married.... and your marriage at a marriage registry is valid.

You must inform IRCC that you incorrectly stated your marital status as single. You can send a web form to the relevant visa office

Thank you for your advise Bryanna. I believe my application is still in process. How do i send a web form ? and what is that? Can you please explain me the process. Appreciate your help.

IMO, it's best not to. You can simply say that you selected the incorrect option.

Hope you have declared your husband + his details in the Family Information form (IMM 5645)

my explanation- This is to change my martial status from single to married. My husband and i are not living together since we got married and he lives in India he never been to USA. So I thought i should apply as single as he is not here or we are not together anymore. But after speaking with my immigration lawyer he advised it is mandatory to keep martial status as Married as i am not legally divorced.

Is this ok ?

No. Stop. This could work against you. Hope you have not declared that you are single for visas of any other countries, including the US?

You cannot "think" about applying for a TRV as 'single'. 'Single' means you've never been married before nor are you in a common-law relationship.

You're married. Legally, your marriage is valid unless it is decreed as 'Null and void' or as "divorced' by a court of law.

I had applied for a Temporary Resident Visa (TRV) on XX date as a paper/online submission. Due to oversight, I inadvertently selected 'Single' for Question 10 of the TRV application form as well as the Family Information form. This was a genuine mistake on my part.

My current marital status is 'Married'. I married Mr.ABC, Indian national holding Indian Passport Number XXXXXXX on XXXX date (date of your marriage). His date of birth is XXXXX and he is currently residing at Address Address, City, India.

Request you to please amend my TRV and Family Information forms with these details

OMG. I am sorry. I already uploaded the documents. No i haven't declared anywhere that i am single. When i spoke with immigration lawyer(murthy law) he said it is always good to tell the truth and they may ask how can you forget in the family information. I dont know whats gonna happen now. Do you think i will face any problem ? or ban from Canada ? i dont know.
