Marrying on a tourist visa

Hello,

I am an Egyptian-Canadian currently in Egypt. My boyfriend and I plan on getting married then living together in Canada. We would like to have the wedding there. How should we go about this? I read that if he manages to get a tourist visa and we marry, then apply for sponsorship, they could perceive this as him lying on his tourist application since he wouldn't have mentioned me. Could this cause them to reject our sponsorship? And if so, what other options are there?

If you want to get married and live together in Canada, then he will need to apply for a TRV (tourist visa) to come here. Once you're married you should apply inland. Provided your relationship is genuine, there is no issue doing this - many have done this. The trick will be getting an approved TRV. This will likely be the difficult step.

Would he have to go back to Egypt after his tourist visa ends even if we are married?
Would it look bad to the officers processing our spousal application if he doesn't?
If we apply inland and get rejected, there is no appeal, so what would happen?
Also, if we get a civil marriage in Egypt and begin the sponsorship process from there, will that help his chances of getting a tourist visa to visit me in Canada?

He would not have to go back to Egypt after his tourist visa ends if you applied for inland sponsorship. He would be inplied visitors status until PR sponsorship is complete.

There is no appeal for negative DM however there is a last resort. Costly and time consuming process called Judicial Review. However you would have to prove you have a case for wrongful refusal. Other than that, he would have to leave Canada once he received a negative DM, if he is on inplied status "didn't extend visitor stay" or he has to leave Canada before the visa permit stay expires.

It is best that he gets a TRV before any sponsorship starts even getting married. Once you applied outland sponsorship, he wil not be able to get TRV after sponsorship or even after marriage. They will assume he will not leave Canada once he is in so they will refuse to issue him a TRV. It won't increase his chance of getting TRV after marriage, in fact, would make it worst.

Are there other restrictions? Whyshould we apply inland instead of out? If he can't get the tourist visa at all what would you suggest?

Outland is good for applicants from visa-exempt countries. Since Egypt is not, inland might be better if you want to be with him in Canada ASAP. Inland would allow him to legally live in Canada while the application is being processed.

Generally outland is good for those from visa exempted countries. And inland is usually good for those who require a visa to enter Canada. There are pros and cons to each route.

Outland

Pro

1. Allow applicant to leave and enter Canada without affecting PR papers.
2. Faster processing route.

Con

1. Applicant can never work in Canada unless applicant get work visa through LMO.
2. Applicant must keep extending visitor stay while in Canada. They don't get implied status.
3. Applicant may have to go back to home country for any interviews.
4. Can appeal a negative decision.

Inland

Pro:

1. Applicant can stay with sponsor during the entire time.
2. Applicant can apply for Open work permit after passing 1st stage.
3. Applicant can get implied status beyond visa stay expire date.

Con:

1. Applicant cannot leave Canada during the entire process.
2. Much longer processing time for PR landing
3. Cannot appeal a negative decision.

If the TRV is denied, should we just get married in Egypt and apply outland? Is there another option?

i was in a similar situation as you are. here is my story: i am a PR and got married in a religious ceremony. i was lacking a document and therefore could not get married officially. So technically we are not husband/wife. Recently, she applied for TRV and with god's grace it is approved (actually the god already stamped our marriage in church).

If relationship is genuine it's gonna be approved sooner or later.

Back to your questions: it's absolutely important to tell the truth. if you are not married, then he does need to mention you in application and once he is here, u can apply for sponsorship. once stage 1 of application passed, he can apply for open work permit.
