Marrying a Canadian and I'm on a Study Permit. Minimum income requirement.

Good day guys,

I am an international student here in Canada. Me and my boyfriend are planning to get married. He is a Canadian but he is a student as well, with only a part time job since he is still in university and he is on student loans. We were wondering if he could sponsor me since he doesnt have a full time job and is on student loans. We are of legal age btw @ 25.

Your replies would be greatly appreciated. :)

you can marry him and he can sponsor you even if he doesn't have income. when it comes to financial requirements, having previously filed for bankruptcy or being on social assistance would be two disqualifying factors. student loans do not count as social assistance so he'll be fine there.

outland because you'll get processed in half the time compared to inland. you'll send your application to CPC Mississauga, who will then forward it to Manila VO for further processing.

I see. So i will have to go home then. I am in Canada already. Maybe taking a vacation out to the islands would be nice while waiting eh. Haha. Approximately how long will it take to get a response? And would it be a PR status or just open work permit? I really am new to this so sorry if i dont know what im talking about. :)

no, you don't have to go home. you can stay for as long as your student visa is valid.

i believe the average wait time for applications processed at Manila VO is 10 months (someone correct me if i'm wrong). once it's approved, you'll get full PR status.

if they request an interview, it'd be held at Manila VO. interviews are rare and they happen when the visa officer sees too many red flags in a relationship (see list below) or suspects possible misrepresentation. this is where you'll have to do research into what kind of proof of relationship you'll need to provide in order to convince the visa officer that your relationship is genuine, and that you're not marrying your boyfriend simply because you want to stay in canada.

e.g. here's a guide they use for chinese nationals marrying white canadians:
INDICATORS OF A ‘NON-GENUINE’ MARRIAGE

University-educated Chinese nationals marrying non-Chinese
Photos without parents or any family members, just a small group of friends
Private marriage ceremony performed by either a minister or justice of the peace
Informal reception in a restaurant
Sponsor is uneducated, with a low-paying job or on welfare
The couple do not kiss on the lips in photos
Couples who do not have a honeymoon, not even a couple of days away, usually because of university and/or no money
There are no “diamond” rings
Wedding photos done professionally but pictures are very limited
Some submit photos dressed in pajamas or cooking, to show they are living together
Photos have them wearing the same clothes in various locations
Are they touching each other in the photos, or trying not to touch?
Photos of activities taken in the Niagara Falls area, Niagara-on-the-Lake and Toronto.

So everything is applied online or is it paper? And i can stay in Canada while waiting for the decisions of the VO right?

Thanks for answering all the major questions in my head though. Its been a good decision joining this forum. Thanks to people like you :)

it's all on paper.

i'd like someone else to chime in on whether or not you'll be able to stay in canada after your study permit expires as i'm not 100% sure myself.

As long you have a valid visa you can stay in canada during the process. The outland application however does not give you a visa, so as long your study permit for Canada is still valid (or any other visa) you can stay in canada. If not or if it expires before the decision is made, then you have to get a valid visitor visa or go home till you get your PR.

You're welcome! ^^

Just so you know (in case you get a interview or anything else) re-entering Canada without a student visa after you send your application and before getting PR can be a lot harder. They are more strict on giving an visitor visa (if you are from a not visa exempt country) when you are married to a Canadian.

Also be sure to pay the required fees and do medical & police check upfront to avoid any possible delays if you are in a hurry and be sure to check the guide for your country on CIC to see what documents you need for the applications (some countries or cities don't give certain documents unless you request them or pick them up in person in that country/city, which means you have to go back).

It's important to be clear on the distinction between a visa and actual status in Canada.

To clarify, a TRV, Temporary Resident Visa, is the stamp in a passport that allows a person to travel to Canada. Status is granted by CBSA upon entry, in the form of a study permit, work permit or visitor status. A person can be in Canada legally with an expired TRV, provided they maintain their status. Conversely, a person can be in Canada illegally while still having a valid TRV if they fail to maintain their status.

You could simply apply online to change conditions and extend your stay as a visitor.
