Hello!

I am really confused about my dilemma below and would highly appreciate some advice. This forum has been a life saver so thank you to all those who contribute!

I am Kenyan by nationality, but studied in the US for 7+ years on a student visa. Last year, I met my husband who is a Canadian citizen. I visited Canada a couple of times on a TRV with no problems. We decided to get married in June and I was advised by a family friend who also happens to be an immigration attorney to enter Canada on a TRV, get married, and then apply for an extension any time before my TRV expires. We got married earlier this month, and my TRV expires on July 2nd, 2014. My OPT (status in the US) also expires on the same date, but I believe that is irrelevant in this situation.

My dilemma is as follows - I have filled out the TRV extension form (IMM 5708) but I am confused as to what reason I should put for my extension? or would it create a problem that I came into Canada with a TRV to get married?

Can I say that I got married and would like to spend time with my husband?
We have a copy of our marriage certificate that I could use as proof?
I thought I would also send a copy of my passport details as well as my husbands?
Proof of how he is going to support me financially, etc?
Are there any other documents I should use for a stronger case?

We have decided to file for an inland application in the upcoming days so the TRV extension is so that I am not out of status at any given point in time. I was also recommended to go the paper route as that would buy us some time.

I am planning to send out the extension forms tomorrow. Any and all suggestions, tips, and advice would be greatly appreciated.

I think you are on the right track. May be you can also include a cover letter explaining how long you have been dating your husband, include some proofs and say that you want to spend some more time with him here as you are recently married.

Yes go the paper way, that should buy you some time.

Is going back to US and coming back later an option ?

I am more or less in the same boat. Let me know how it goes please.

I would normally suggest an Open Work Permit (OWP) submitted with an Inland application, which would give the applicant implied status. IF you can get your Inland application and an OWP submitted and RECEIVED by CIC on, or before July 2nd, that might be an option for you.

It's possible that your TRV extension will also give you implied status, so perhaps you could still submit the Inland application and OWP (before you hear back on the TRV extension request). This way, if your TRV is denied, you'd still have implied status from the OWP, since it would have been submitted prior to your status expiring...in theory.

Hopefully, a member with more knowledge about this will follow-up and confirm, or educate me even further. :)

This was very good advice. If you get married and THEN try to get a TRV they usually won't give it to you.

Yes definitely. That is is a perfectly valid and commonly accepted reason for extending a TRV. I dont think you will have any issues.

As stated by Ponga, try to put your OWP app in with the inland app.

Yes, the plan is to submit the OWP with the Inland application while TRV extension is in process to take advantage of the implied status :).
