Married before

Can anyone suggest what I can do to help my application. It's already been sent in. 7 weeks ago. I was married before but we went our separate ways very soon after. I was young and not ready. Any I have not seen him or do not know where he is. We have not been in contact in over seven years. I explained the situation in a detailed letter for application. I am now in a common law relationship with a 5 year old son together. Do you think they will ask for proof of separation?

What country are you from? You should apply for a divorce if possible. Of course, it is possible to sponsor and be sponsored common-law even if one partner is still married to someone else. It is up to the visa officer as to whether what you have submitted is enough evidence of separation. That is, living with someone else is good proof in itself; that, plus the letter of explanation, may be enough.

Thank u Canadianwomen. I am from the uk but my ex is from Brazil. He was in the uk at the time. We got married in Brazil but I never did register it in the uk. I don't know how to go about divorce if I have no idea where he is from. I have submitted lots of evidence of common law relationship. I don't even have a marriage certificate. To me it was a shambles a stupid mistake

I havent tried this but you can give this a try.

Go to the brazil consulate office if you have one in your area and ask about the process in getting a divorce.

While the divorce process is on going you can still go on with your application under the common law,family class sponsorship. The most important thing is that you can prove your relationship as common law. It would help a lot in your application if you both have a joint bank account, properties that named to both of you. Even those small details in your relationship would do big in your application like photos, letters, cards and even movie tickets and travel itineraries and tickets. Having a 5year old child for me is already a proof of your relationship but it is better to add other mentioned above.

I am a filipino and also waiting for my application approved.

Most of the people I knew who was married here in the Philippines are getting divorce in canada and marry someone in canada. We dont have a divorce here in the Philippines. Try to ask also your govt if its possible for you to have and file a divorce in uk with your previous marriage in brazil.

Please take note also that you are applying under common law and not spouse outside canada. If you got the divorce and decided to get marry with your common law husband right now, you may have to change your application to the latter. That would mean withdrawing the first application and submitting new one under the spouse-family class sponsorship. By the way, is your child a canadian citizen?

We don't plan to marry just yet we are perfectly happy as we are. One day when our financial situation is better. I will then know a divorce is a must. Yes my child was born here in Canada

Incorrect. There is no need to withdraw a common-law app after getting married. They can simply send a copy of the marriage certificate to update the app.
