My partner came to Canada 1 year ago from Iran on a work visa. His Visa expired in May and he was unable to renew his work permit. During the time he was in Canada he has made some political statements regarding his home country and if he were to go back, he would be punished.
So he applied for refugee status and is currently awaiting his hearing.
However, as our relationship has progressed we would like to get married, and then I could sponsor him. This would have more benefits as his family would be able to visit in the future; and we could possibly sponsor someone else later on.
My questions are : what are the risks in switching from a refugee application to a sponsorship application? Does he have to withdraw his refugee application before marrying me? His passport was seized, although he has a certified copy of it; other than that he doesn’t have id. Would that be enough to get a marriage certificate?
We will be contacting an immigration lawyer but I wanted to ask here first.
