Marriage before landing - Common-law COPR

Hi all,

Thanks for all your brilliant help through the process, but I have one more question.

We have now received our COPR, I (Canadian Citizen) have sponsored my common-law spouse. We must arrive before September, however we are set to marry in July and don't have a trip to Canada planned in the meantime (trying to save for the wedding!)

Now my questions:

1. If we (applicant) do not land prior to the wedding, will there be problems with immigration?
2. If 1 above is no, do we need to contact CIC? If so - who do we contact, and how?
3. If 2 above is true, how long will that take? We would want to land in Canada 3 weeks after marriage, and are unlikely to have our marriage certificate yet.

I've tried to call CIC multiple times to discuss, but with no avail as of yet. It seems relatively simple as we're going from common law to married - but this may not come up so often!

In this particular case, the fact that your dependant is already approved as part of the application, it makes absolutely no difference to the outcome of the application if you are married or common-law, as it would not affect the decision. On this basis, I believe that you are safe to proceed with the marriage and subsequent landing.

IRPA defines it as such.

• 40 (1) A permanent resident or a foreign national is inadmissible for misrepresentation
  • (a) for directly or indirectly misrepresenting or withholding material facts relating to a relevant matter that induces or could induce an error in the administration of this Act;

I agree with the above. Your partner is already approved and getting married would not change the outcome of the app. Just let CBSA know when landing.

Thank you both! I assumed it would not matter, nor did I think there would be anyone else in the same boat!

I certainly don't want to 'risk' it but can't see it being a problem.

Hi I'm really interested in following your outcome here as my partner and I are wanting to get married 6 days before we move from NZ to Canada. He is a Canadian Citizen who sponsored me under common law spouse. I was approved and received my CoPR in May. I'm worried that gettin married in NZ before landing will make my CoPR invalid when I try to land....

It won't invalidate your COPR, as the marriage wouldn't change the outcome of the app.
